ESTABLISHING AND IMPLEMENTING A ROADSIDE TRAFFIC ARBITRATION IN METRO MANILA AREA TO HEAR AND RESOLVE TRAFFIC VIOLATION COMPLAINTS OF APPREHENDED DRIVERS/MOTORISTS

WHEREAS, the Metropolitan Manila Development Authority (MMDA) under Republic Act 7924 is mandated to deliver basic metro-wide services such as traffic management in Metro Manila;

WHEREAS, there have been numerous reports of " Kotong " activities/extortion allegedly perpetrated by MMDA Traffic Enforcers;

WHEREAS, said " Kotong " activities/extortion are usually committed during the actual apprehension of drivers/motorists along the road/streets of Metro Manila;

WHEREAS, apprehended drivers/motorists often succumb to this activity/practice in order not to be delayed and/or bothered of having to go to the office to redeem and/or contest the citation indicated in the apprehensions;

WHEREAS, it is imperative to stop said illegal activities and at the same time respond quickly to contested apprehensions made by MMDA Traffic Enforcers;

WHEREAS, a Roadside Traffic Arbitration is hereby established along major thoroughfares and intersections in Metro Manila to hear and resolve contested apprehensions filed by apprehended drivers/motorists;

NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of RA 7924 that the Council hereby establishes and implements a Roadside Traffic Arbitration in Metro Manila Area to hear and resolve traffic violation complaints of apprehended drivers/motorists.

RESOLVED FINALLY, that the MMDA Chairman shall issue the necessary implementing guidelines for this purpose.

Let copies of this Resolution be furnished to the Local Government Units of Metro Manila.

This Resolution shall take effect upon approval.
