a money-making scheme of the foundation to the great prejudice of the public

balance for the year 2005 was only 0.20% of its minimum aggregate promised loans,26 which means that it can only grant the promised loan to a maximum of only five (5) members without financing its daily operations. Moreover, the CED found out in its investigation that NELFI's total funds

and charges paid by its members, the total number of which, as of 2007, was regarding the sources of its funds. NELFI refused to disclose the specific sources of its funds when petitioner CED inquired of the same. NELFI's Operation Plan27 for the year 2004-2009, certified28 by Jeremias S. Toires, chairman and president of NELFI, merely states that NELFI shat! receive "donations and grants from foreign countries and iocal." When compelled by the CED to furnish the Commission a certification of the sources of funds, Torres still refused on the the Commission approves its application for failed to appear before the CED despite num him, raising the presumption that he is deliberately evading the possibility of being questioned with regard to NELFI's alleged fraudulent activities. Since no proof was established determining the particular sources of NELFI's funds, it augurs weil with petitioner's conciusion that the foundation's funds came from the miscellaneous fees targeted at eighteen million (18,000,000) members throughout the country. This could easily transform to millions or even billions of pesos worth of funding, which are being extorted from unsuspecting members.
