AMENDMENT TO PART II SEC. 2 OF DEPARTMENT ORDER NO. 98-1177 (FEES AND CHARGES FOR AIR NAVIGATION FACILITIES)

In accordance with Executive Order No. 159 dated 23 February 1994, as implemented by Department of Finance and Department of Budget and Management Joint Circular No. 2-94 dated 14 December 1994, directing revision of fees and charges at just a reasonable rates to recover full cost of services rendered, Sec. 2, Part II of D.O. No. 94-764, as amended by D.O. No. 98-1177, is hereby further amended to read as follows:

OPERATIONAL CHARGES

“Sec. 2. Overflight — A Charge in U.S. Dollar or its Peso equivalent at the time of payment based on the derived formula for calculating Air Navigation Charges (ANC) which is equal to the distance (D) flown by an aircraft in kilometer divided by one hundred (100) and multiplied by its weight factor (W)”

ANC (U.S.) = D/100 x W

The weight factor (W) was determined to have the following values:

MTOW Weight Factor (W)

More than 300 tons 43

200-300 tons 36

100-200 tons 28

50-100 tons 20

20-50 tons 14

Less than 20 tons 7

REPEALING CLAUSE

All previous orders, rules and regulations or part thereof, which are inconsistent with any of the provisions herein, are deemed repealed or modified accordingly.

EFFECTIVITY

This Order shall be published once a week for two (2) consecutive weeks in two (2) newspapers of general circulation in the Philippines and the same shall be effective fifteen (15) days after the last publication.
