AMENDMENT OF THE GUIDELINES FOR THE TEMPORARY UTILIZATION OF INTER-ISLAND VESSELS IN THE OVERSEAS TRADE/OPERATION

Pursuant to the Philippine initiative in the Brunei Darussalam-Indonesia-Malaysia-Philippines East ASEAN Growth Area (BIMP-EAGA) arrangement to establish sealinkages in the EAGA thereby facilitating the development of the area, Section III and Section V of Memorandum Circular No. 86 dated 05 August 1995, are hereby amended and shall read:

" III. Vessels which will be utilized in the East ASEAN Growth Area (EAGA)

An inter-island/coastwise vessel that will be utilized in the East ASEAN Growth Area (EAGA) pursuant to this Circular shall not be covered by the provisions of paragraph 1.8 AND THE RESTRICTION UNDER SECTION II AND SECTION IV HEREOF, PROVIDED THAT, THE VESSEL SHALL STRICTLY COMPLY WITH ANNUAL DRYDOCKING REQUIREMENT . However, temporary overseas trading with the same vessel outside of the East ASEAN Growth Area during the validity period of the special permit covering its trading in the EAGA, shall be covered by another Special Permit and shall not be exempted from the provisions of Paragraph 1.8 and from restriction under Sections II and IV hereof .”

" V. A non-refundable processing fee shall be charged by MARINA in accordance with the following schedule:

Over three months but not more than six months

P4,000.00

Over six months but not more than one year P6,000.00

OVER ONE YEAR (FOR EAGA VESSELS ONLY) P6,000.00 PER YEAR PLUS ANY FRACTION THEREOF THE CORRESPONDING FEES ABOVE SHALL BE IMPOSED

This amendment shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
