AMENDING RESOLUTION NO. R-465 S. 1990 CONFIRMING THE POSITION OF NHA THAT IT IS EXEMPTED FROM THE REGISTRATION AND LICENSING REQUIREMENTS OF PD 957
WHEREAS, finding the arguments of the NHA to be valid, reasonable and in accordance with the law, this Board has confirmed in its Resolution No. R-465 Series of 1990 NHA’s position that its Housing Projects are exempted from the registration and licensing requirements of Presidential Decree 957; WHEREAS, some issues and problems in the interpretation and application of said resolution in the case of joint venture projects are being anticipated in the light of the variable conditions/arrangements that are necessarily attendant to the operationalization of joint venture projects;
WHEREFORE, in the interest of clarifying and resolving this matter be it Resolved, as it is hereby Resolved, that the dispositive portion of Resolution No. R-465 be amended by rewording the same to read as follows;
“X X X WHEREFORE, be it RESOLVED, as it hereby RESOLVED, that this Board confirms the position of the NHA that it is not required to secure a license to sell as contemplated in P.D. 957, for all its housing and settlement projects with this Board. PROVIDED THAT IT SHALL FURNISH COPIES OF PROJECT PLANS, TITLES AND OTHER PERTINENT RECORDS FOR REFERENCE PURPOSES; PROVIDED FURTHER THAT THIS RESOLUTION SHALL APPLY TO JOINT VENTURE PROJECTS ONLY IN CASES WHERE THE NHA IS THE OWNER OR IS IN FULL CONTROL OF THE PROJECT OTHERWISE ASSUMES RESPONSIBILITY FOR ENSURING ATTAINMENT OF THE OBJECTIVES OF PD 957 AND OTHER EXISTING LAWS. X X X”
