[ CID LAW INSTRUCTIONS NO. 31, June 08, 1988 ]

SUMMARY DEPORTATIONS

The Immigration Act, Sections 10 and 15, provides that aliens "must present for admission into the Philippines unexpired passports or official documents in the nature passports, issued by the government of the countries to which they owe allegiance, or other travel documents showing their origin and identity, as prescribed by regulations."

Hence, if the foreign embassy cancels the passport of the alien, he loses the privilege to enter or remain in this country. The automatic loss of the privilege obviates deportation proceedings under the Immigration Act, Section 37; or the Administrative Code, Section 69.

In this instance, the Board of Commissioners may issue summary judgment of deportation, which shall be immediately executory.

Adopted: 8 June 1988

(SGD.) MIRIAM DEFENSOR SANTIAGO

Commissioner
