EXTENSION OF THE GRANT OF AUTONOMOUS AND DEREGULATED (A AND D) STATUS TO EXISTING AUTONOMOUS AND DEREGULATED HEIs; AND

SUBJECT : EXTENSION OF THE GRANT OF AUTONOMOUS AND DEREGULATED (A AND D) STATUS TO EXISTING AUTONOMOUS AND DEREGULATED HEIs; AND

EVALUATION OF PENDING APPLICATIONS FOR 1) THE GRANT OF A AND D STATUS: 2) UPGRADING OF AUTONOMOUS FROM DEREGULATED STATUS

In accordance with the pertinent provision of Republic Act (RA) No. 7722, otherwise known as the "Higher Education Act of 1994," by virtue of Commission en bane Resolution No. 087-2012 dated 16 April 2012, and for the purpose of providing transitional mechanisms while conducting consultations on key reforms aimed to rationalize the higher education system and thereby enhance its contribution to national development, the Commission hereby promulgate the following:

Autonomous (A) and Deregulated (D) Status

Extension of A or D Status

Only HEIs identified as Autonomous in 2007 to 2009 shall have their respective status automatically extended until 31 May 2014 and shall enjoy all the benefits specified in Article VI of CMO No. 44, s. 2008 except for Sections 32 and 33, which provide the privilege to 1) establish branch(es) or satellite campus(es) and 2) offer extension classes to expand access to higher education, respectively. Authority from CHED will be required for both new campuses and extension classes.

Only HEIs identified as Deregulated in 2007 to 2010 shall have their respective status automatically extended until 31 May 2014 and shall enjoy all the benefits specified and extension classes.

Pending application for the grant

All pending HEI applications for autonomous or deregulated status submitted to CHED on or before 27 January 2011 (The Memorandum from the Chairperson on the Deferment of the Implementation of the Quality Assurance Programs of the Commission was issued) shall be evaluated for the grant using CMO No. 44, s. 2008. If granted, their status will expire on 31 May 2014.

Upgrading of status from Deregulated to Autonomous Status

HEI applications for the upgrading from deregulated to autonomous HEI status that are received by CHED on or before 31 May 2012 shall be processed and evaluated using CMO No. 44, s. 2008. If approved, their autonomous status will expire on 31 May 2014.

HEIs granted autonomous status up to 31 May 2014 shall enjoy all the benefits specified in Article VI of CMO No. 44, s. 2008 except for Sections 32 and 33, which provide the privilege to 1) establish branch(es) or satellite campus(es) and 2) offer extension classes to expand access to higher education. Authority from CHED will be required for both new campuses and extension classes.

This CMO shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation and shall remain in force and effect until the specified date of expiration or until otherwise revoked or suspended.
