INCLUSION OF KETAMINE IN THE LIST OF DANGEROUS DRUGS AND AMENDING SEC. 32-6(B) OF BOARD REGULATION NO. 3, S. 2003 AND IN THE LIST OF DANGEROUS DRUGS TO BE PRESCRIBED IN A SINGLE APPLICABLE PRESCRIPTION BY A LICENSED PRACTITIONER

Pursuant to Section 93, Article XI of Republic Act No. 9165, otherwise known as the "Comprehensive Dangerous Drugs Act of 2002", the Board, upon the recommendation of the Philippine Drug Enforcement Agency (PDEA) and after a public hearing held on 14 June 2005, hereby promulgates as follows:

SECTION 1. CLASSIFICATION AS A DANGEROUS DRUG - any material, compound, mixture or preparation which contains any quantity of KETAMINE, including its salts, isomers, and salts of isomers within the specific chemical designation, by whatever official, common or unusual or brand name or designation is classified as a dangerous drug.

SECTION 2. EXCEPTION - Section 1 hereof shall not apply to any preparation containing KETAMINE, whenever the same preparation is prescribed by licensed practitioner. Provided that:

a. each vial shall not contain more than fifty (50) mg. / ml. X ten (10) ml. of KETAMINE; and

b. the single prescription therefore to be filled by either a hospital or community drug store shall be for a maximum dosage of 1.5 grams equivalent to not more than three (3) vials per day for a period not exceeding thirty (30) days.

SECTION 3. CONTROL OF KETAMINE - except as herein provided, KETAMINE shall be subject to all regulatory and control measures as may be provided under RA 9165 and under the rules and regulations of the Board.

SECTION 4. VIOLATIONS - any violation of this Regulation shall be ground for filing the appropriate criminal case against the violator, without prejudice to such administrative sanctions as may be provided under the Act and the rules and regulations of the Board.

SECTION 5. EFFECTIVITY - This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and after registration with the Office of the National Administrative Register (ONAR), UP Law Center, Diliman, Quezon City.
