EXECUTIVE ORDER NO. 07 - AMENDING EXECUTIVE ORDER NO. 43 (S. 2011) ENTITLED "PURSUING OUR SOCIAL CONTRACT WITH THE FILIPINO PEOPLE THROUGH THE REORGANIZATION OF THE CABINET CLUSTERS" TO DESIGNATE THE DEPARTMENT OF NATIONAL DEFENSE SECRETARY AS THE CHAIRPERSON OF THE SECURITY, JUSTICE AND PEACE CLUSTER

AMENDING EXECUTIVE ORDER NO. 43 (S. 2011) ENTITLED "PURSUING OUR SOCIAL CONTRACT WITH THE FILIPINO PEOPLE THROUGH THE REORGANIZATION OF THE CABINET CLUSTERS" TO DESIGNATE THE DEPARTMENT OF NATIONAL DEFENSE SECRETARY AS THE CHAIRPERSON OF THE SECURITY, JUSTICE AND PEACE CLUSTER

WHEREAS, EO No. 43 (s. 2011) reorganized the Cabinet into five (5) Clusters, namely: (1) Good Governance and Anti-Corruption; (2) Human Development and Poverty Reduction; (3) Economic Development; (4) Security, Justice and Peace; and (5) Climate Change Adaptation and Mitigation;

WHEREAS, Section 9 of EO No. 43 provided that the Executive Secretary shall be the Chairperson of the Security, Justice and Peace Cluster;

WHEREAS, Section 3 of EO No. 99 (s. 2012) included the Cabinet Secretary as member of all the Cabinet Clusters;

WHEREAS, the Department of National Defense (DND) has the mandate to ensure national peace and security, protect Philippine sovereignty, and uphold the territorial integrity of the country; and

WHEREAS, there is a need to designate the DND Secretary as Chairperson of the Security, Justice and Peace Cluster in order to ensure that the thrust of the Government to suppress and prevent lawless violence, and win the fight against crimes, particularly illegal drugs and corruption is achieved;

NOW, THEREFORE, I, RODRIGO ROA DUTERTE, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

SECTION 1. Section 9 of EO No. 43 is hereby amended to read as follows:

"Section 9. Security, Justice and Peace. The Security Cluster shall ensure the preservation of national sovereignty and the rule of law; focus on the protection and promotion of human rights and the pursuit of a just, comprehensive, and lasting peace. In particular, the Security Cluster shall pursue the following goals:

Protecting our national territory and boundaries;

Attaining a just and lasting peace;

Ensuring the welfare of the Overseas Filipino Workers;

Strengthening the rule of law;

Institutionalizing an efficient and impartial justice system that delivers equal justice to the rich and poor; and

Advancing and protecting human rights.

The Cluster shall be composed of the following:

Chair: Secretary, Department of National Defense

Members: The Executive Secretary Cabinet Secretary Secretary, Department of the Interior and Local Government Secretary, Department of Foreign Affairs Secretary, Department of Justice National Security Adviser Presidential Adviser on the Peace Process

Secretariat: National Security Council"

SECTION 2. Repealing Clause. All other issuances or parts thereof inconsistent with the provisions of this Executive Order are hereby repealed or amended accordingly.

SECTION 3. Effectivity. This Order shall take effect immediately.
