REVISION OF PENALTIES FOR NON-SUBMISSION AND NON-COMPLIANCE WITH CAB REPORTING REQUIREMENTS

The Board Resolved, to order all foreign and domestic air carriers, including international and domestic airfreight forwarders to submit to the Board its financial and operational reports on or before the due sates and in the prescribed CAB forms as duly provided by law.

It is further resolved, that the revised penalties to be imposed on any air carrier or airfreight forwarder for the violations or failure to comply with the above paragraph without justifiable cause are as follows:

1. Delay in the submission of a report not exceeding two (2) months

2. Delay exceeding two (2) months but not exceeding four (4) months

-

P2,000.00

3. Delay exceeding four (4) months not exceeding six (6) months

-

P4,000.00

4. Delay exceeding six (6) months but not exceeding eight (8) months

-

P6,000.00

5. Delay exceeding eight (8) months but not exceeding ten (10) months

-

P8,000.00

6. Delay exceeding ten (10) months but not exceeding one (1) year

-

P10,000.00

7. Delay over one (1) year

-

P10,000.00 or suspension of revocation of a permit to operate the service or both, at the discretion of the Board.

8. Non-compliance or erroneous reporting in the submission of reports shall carry the penalty of P10,000.00

All affected parties of the above are hereby ordered to show cause why they should not be penalized for their failure to submit the reports required of them by this body. Failing which, the Board shall hereby impose the necessary penalty prescribed herein.

The imposition of the above penalties/fines shall take effect immediately after fifteen (15) days of its publication in the newspaper or general circulation.
