AMENDMENTS ON PPA ADMINISTRATIVE ORDER NO. 11-95

1. Authority — PPA Board Resolution No. 1567 * adopted on March 29, 1996.

2. The provisions of PPA Administrative Order No. 11-95 regarding the application of the Fixed Fee policies that may result in deviation from the provisions of existing cargo handling agreements/contracts are hereby modified.

3. Amending Guidelines —

3.1 The scope of PPA Administrative Order 11-95 dated January 25, 1995 shall apply only to future cargo handling contracts executed/granted after its effectivity on March 7, 1995. Sec. 4.1 thereof is hereby amended as follows:

"This Order shall apply to cargo handling contracts in all government ports containing stipulation on the Revised Fixed-Fee executed after the effectivity of this Order."

3.2 Reference to the applicability of Sections 5.1 and 5. 2 of said AO 11-95 to existing cargo handling contracts with Fixed Fee/Variable Fee and Revised Fixed Fee is likewise amended to mean and apply only to future contracts.

3.3 All other provisions of Administrative Order 11-95 shall remain valid.

4. Effectivity —

4.1 This Order shall take effect upon approval and shall remain in full force and effect until revoked.
