IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11980 OTHERWISE KNOWN AS "AN ACT STRENGTHENING THE BULACAN STATE UNIVERSITY (BULSU), EXPANDING ITS CURRICULAR OFFERINGS AND THE COMPOSITION OF THE GOVERNING BOARD, AND APPROPRIATING FUNDS THEREFOR"

A RESOLUTION APPROVING THE IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT NO. 11980 OTHERWISE KNOWN AS "AN ACT STRENGTHENING THE BULACAN STATE UNIVERSITY, EXPANDING ITS CURRICULAR OFFERINGS AND THE COMPOSITION OF THE FUNDS THEREFOR" OR THE "REVISED BULACAN STATE UNIVERSITY CHARTER"

WHEREAS, on February 15, 2024, the President of the Philippines, Hon. Ferdinand Romualdez Marcos, Jr., signed into law the Republic Act No. 11980, otherwise known as "An Act Strengthening the Bulacan State University, Expanding its Curricular Offerings and the Composition of the Governing Board, and Appropriating Funds Therefor: or the "Revised Bulacan State University (BulSu) and its constituent units shall be strengthened as a state university to enhance its capability to provide accessible quality education, It shall also be further strengthened by expanding its curricular offerings and the composition and powers of its governing board, developing the competencies and encouraging the specialization of its constituent units, engaging in conventional or alternative instructional techniques, methodologies and strategies, and fostering a unique and distinctive academic leadership towards the improvement of BulSU as an academic institution and the delivery of higher education services in the Province of Bulacan and Central Luzon Region.

WHEREAS, Section 28 of the aforementioned law mandates the BulSU Board of Regents, in consultation with the Commission on Higher Education (CHED), to formulate rules and regulations to fully implement the provisions of the Act within ninety (90) days from the effectivity of the Act.

WHEREAS, on March 12, 2024, the University President issued an Office Memorandum (no. 58), designating the members of the Technical Working Group primarily tasked to draft the IRR of RA 11980. The following persons where designated to ensure proper representation from all sectors concerned, viz:

WHEREAS, the IRR TWG has been duly constituted to formulate the detailed guidelines and mechanisms necessary for the effective implementation of the provisions of the said law. The IRR TWG has diligently deliberated on various aspects of RA 11980 to ensure that the IRR aligns with its objectives and spirit.

WHEREAS, after thorough consultations, research, and deliberations, the IRR TWG has finalized the draft IRR for RA 11980. The draft IRR embodies the principles of equity, excellence, and inclusivity, which are central to the objectives of RA 11980. It delineates procedures, standards, and responsibilities to guide BulSU in fulfilling their mandates under the law. Furthermore, the draft IRR has undergone meticulous review and scrutiny to address any potential ambiguities or inconsistencies. The IRR TWG has endeavored to strike a balance between flexibility and specificity, recognizing the diverse contexts and needs of BulSU.

WHEREAS, during the 2nd Regular Board Meeting held on May 17, 2024, it inputs given by different BOR Members on a meeting conducted by the committee held for a purpose headed by the Chair of the committee.

WHEREAS, on May 22, 2024, a Special Meeting was conducted in order to finalize the Implementing Rules and Regulations of the Republic Act 11980. All concerns were address and inputs from the honorable members were consolidated to stipulate in the final IRR of RA 11980.

NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, that the Implementing Rules and Regulations (IRR) of Republic Act No. 11980 otherwise known as "An Act Strengthening the Bulacan State University, Expanding its Curricular Offerings and the Composition of the Governing Board, and Appropriating Funds Therefor" or the "Revised Bulacan State University Charter" is hereby APPROVED.

IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11980 OTHERWISE KNOWN AS "AN ACT STRENGTHENING THE BULACAN STATE UNIVERSITY (BULSU), EXPANDING ITS CURRICULAR OFFERINGS AND THE COMPOSITION OF THE GOVERNING BOARD, AND APPROPRIATING FUNDS THEREFOR"

To effectively carry out the implementation of the provisions of Republic Act No. 11980, also known as "An Act Strengthening the Bulacan State University, Expanding its Curricular Offerings and the Composition of the Governing Board, and Appropriating Funds Therefor ("Act")", the Bulacan State University (BulSU), in the exercise of its authority as provided by the Act hereby promulgate the following rules and regulations.

Rule I

GENERAL PROVISIONS

SECTION 1. Promulgation. - Pursuant to Section 28 of the Republic Act (RA) No. 11980, otherwise known as "An Act Strengthening the Bulacan State University, Expanding its Curricular Offerings and the Composition of the Governing Board, and Appropriating Funds Therefor", within ninety (90) days from the effectivity of this Act, the Governing Board, in consultation with the Commission on Higher Education (CHED), shall formulate the rules and regulations to fully implement the provisions of this Act.

SEC. 2. Title. - These rules and regulations shall be referred to as the "Implementing Rules and Regulations of Republic Act No. 11980" (IRR).

Rule II

LEGAL BASES

SECTION 1. Governing Law. - Republic Act No. 11980, which strengthens the BulSU, delineates the composition and authority of its Governing Board and expanded its curricular offerings.

SEC. 2. CHED Charter. - Republic Act No. 7722, commonly referred to as the "Higher Education Act of 1994," establishes the structure and framework for the governance of both public and private institutions of higher education, along with the degree-granting programs across all post-secondary educational institutions.

SEC. 3. Higher Education Modernization Act of 1997. - Republic Act No. 8292, known as "An Act Providing for the Uniform Composition and Powers of the Governing Boards, the Manner of Appointment and Term of Office of the President of Chartered State Universities and Colleges, and for Other Purposes" grants the Governing Board the power to promulgate rules and regulations to carry out its purposes and functions of the university, CMO No. 7, s. 2022, "The 2022 Revised Implementing Rules and Regulations (IRR) of RA 8292, Amending CHED Memorandum Order No. 03, s. 2001 and other Related Relevant Memoranda and Circulars."

Rule III

DEFINITION OF TERMS

SECTION 1. Definition of Terms. - Whenever used in the IRR, the following words or phrases shall mean or refer, thus:

a. Act refers to Republic Act (RA) No. 11980, otherwise known as "An Act Strengthening the Bulacan State University (BulSU), Expanding its Curricular Offerings and the Composition of the Governing Board, and Appropriating Funds Therefor."

b. Auxiliary Services refers to a spectrum of supplementary offerings or services provided by State Universities and Colleges (SUCs) to support the comprehensive needs of students, faculty, and other stakeholders of the university, which extend beyond its core academic functions and may include but are not limited to cafeteria, janitorial services, printing press, hospitals, bookstore, and other ancillary resources essential for the functioning and enrichment of the academic community. Auxiliary services are deemed integral components of the educational framework, contributing significantly to the holistic development and well-being of those within the academic environment.

c. Campus Director also referred as Campus Dean refers to a person officially appointed or designated by BulSU to lead and cultivate educational initiatives specific to their assigned college or campus.

d. Chairperson of the Board refers to the CHED chairperson or to the CHED Commissioner, duly designated as Regular Chair and Presiding Officer of the Governing Board.

e. Chancellor refers to a person officially appointed by the Governing Board, upon the recommendation of the search committee and the BulSU President, who will be in charge of the implementation of policies, plans, and programs concerning organizational, operational, and academic functions of the assigned campus/es of the University and perform direct administration.

f. Co-Chair refers to the President of the BulSU, duly designated as the regular Vice-Chair and presiding officer in the absence of the Chair.

g. Commission on Higher Education refers to the government agency created under Republic Act No. 7722, otherwise known as the "Higher Education Act of 1994" which has jurisdiction over all higher education institutions (HEIs), public or private, in the Philippines.

h. Constituent Units refers to an integral component BulSU which operates within the broader framework of the university.

i. Community Laboratory refers to a community adopted by an SUC as part of its extension program or outreach where research and civic activities are conducted by its students and faculty.

j. Distance Education is a mode of educational delivery, local or foreign, whereby the teacher and the learner are physically separated from each other, and instruction is delivered through appropriate communication technologies using specially designed materials and methods, supported by organizational and administrative arrangements and structures.1

k. Dual Training System refers to a teaching-learning approach utilizing both the experiences gained by students inside and outside the classrooms, usually through industry immersion, sometimes called the in-school, off-school approach.

l. Extension campus refers to a campus established by the University in a municipality or city within the same province or region where the main campus is located, with no or limited administrative and support personnel.2

m. Extension Class is a class normally offered by a recognized higher education institution in its main campus but is conducted in another location not otherwise specified in the permit or recognition issued by the commission for the operation of the programs.3

n. Extension Center refers to an entity established within the SUC to mobilize knowledge and technology towards enhancing productivity, generating employment and reducing poverty including transfer and/or application of technology/knowledge that contribute to the attainment of the country's development goal.4

o. External Campus refers to a campus identified under Section 3, Rule V hereof and to those other campuses which may be established by law.

p. Federation refers to an organization of associations which is established and registered to pursue shared objectives beneficial to the interests of both the constituent associations and their members.

q. Federation of Alumni Associations refers to the federation of such alumni associations to include all levels of education (e.g., basic, secondary, tertiary and graduate programs).

r. Federation of Faculty Association refers to such federation of faculty associations comprised of duly registered or accredited faculty federation representing no fewer than the required membership requirement contained in its Constitution and By-laws and duly registered or accredited by the Civil service Service Commission-Personnel Relations Office (CSC-PRO) and the Department of Labor and Employment - Bureau of Labor Relations (DOLE-BLR) which is established to provide mutual aid and protection to their members.5

s. Flexible Learning is a pedagogical approach allowing flexibility in the timing, location, and audience of learning, without being exclusively centered on technology. While it often incorporates distance education delivery methods and educational technology tools, its implementation can vary depending on factors such as the level of technological infrastructure, access to devices, internet connectivity, digital literacy levels, and instructional approaches.6

t. Governing Board (GB) refers to the highest policy-making body of SUCs which is the Board of Regents (BOR).

u. Laboratory School refers to the foundational educational institution of BulSU, offering programs from early childhood through primary, junior, and senior high school, as well as special education. It operates under the guidance of the College of Education and serves as a platform for practice teaching and other activities associated with the education degree program.

v. Information Technology refers to utilizing technology for the distribution of information and for implementing instructional and distance education delivery methods.

w. Main Campus refers to the campus where the central or university-wide administration of BulSU conducts its business and where its President holds office permanently which shall remain in the City of Malolos, Bulacan.

x. Non-Teaching refers to association representing the Non-Academic Personnel of BulSU. The President of this association or their duly appointed representative will serve as their representative in the GB.

y. Open Distance Learning refers to the merger of the two (2) concepts, that of open learning and distance education. It is a system which combines the methodology of distance education to philosophy of open and flexible learning.7

z. Open Learning refers to a philosophy of student-centered approach to education, emphasizing flexibility in the learning process, thus enabling them to learn at their own time, location, and preferred pace, tailored to their individual circumstances and needs.

aa. Private Sector Representative (PSR) refers to a prominent citizen from the Province of Bulacan, known in the private sector for his.her distinguished expertise, profession or field of specialization which is aligned with the mission of the SUC. He/she must not have any disqualification/s as outlined in this IRR.

bb. Research Center refer to an entity within the SUC designed to conduct research and development in accordance with its legal mandate. It operates under a formal structure governed by relevant rules and regulations.

cc. Special Trust Fund refers to the total amount collected or charged from the students for tuition and other fees for a specific purposes, subject to the provisions of Republic Act No. 10931, otherwise known as the "Universal Access to Quality Tertiary Education Act" including the collection and receipts from sources than other than payment of tuition fees, held in trust by the college or university.8

dd. State Universities and Colleges (SUCs) refer to public HEIs in the Philippines established by law with independent and separate Governing Boards.

ee. Technical Education and Skills Development Authority (TESDA) Courses refer to technical-vocational courses as authorized by the TESDA.

ff. Tertiary Programs refers to four- or five-year degree programs in the undergraduate level and graduate programs such as master's and doctoral degree offered by the University.

gg. TVET Programs are technical vocational education and training programs which may be embodied in a degree.

hh. University refers to Bulacan State University

Rule IV

COVERAGE, APPLICATION AND CONSTRUCTION

SECTION 1. Coverage. - This IRR shall apply to and cover all campuses of the University. It shall include all other campuses and research and extension centers that may be established thereafter.

SEC. 2. Application and Construction. - The provisions outlined in the IRR are intended to ensure the fulfillment of the University's vision, mission, objectives, goals, mandates, intents, and purpose. The University is committed to delivering high-quality higher education and fostering global competitiveness. Additionally, it upholds academic freedom and institutional autonomy in compliance with applicable laws, rules, regulations, and established jurisprudence. Consequently, any ambiguity regarding the interpretation and application of this IRR will be interpreted liberally in favor of the University.

In matters concerning the well-being of students, faculty members, and non-teaching personnel, any ambiguities in the interpretation and implementation of this IRR will be resolved in their favor subject to existing laws, rules, and regulations.

Rule V

THE UNIVERSITY CAMPUSES

SECTION 1. The Main Campus. - The main campus of the University refers to the campus where the central or university-wide administration of BulSU conducts its business and where its President holds office permanently which shall remain in the City of Malolos, Bulacan.

SEC. 2. The External Campus. - The external campuses of the University are BulSU Sarmiento Campus, City of San Jose del Monte, Bulacan, BulSU San Rafael Campus, Municipality of San Rafael, Bulacan, BulSU Bustos Campus, Municipality of Bustos, Bulacan, BulSU Meneses Campus, Municipality of Bulakan, Bulacan, BulSU Hagonoy Campus, Municipality of Hagonoy, Bulacan and all other constituent units, regular and external campuses that may be established in the future by the University in a municipality or city within the same province or region where the main campus is located, with no or limited administrative and support personnel.9

In consonance thereto, BulSU shall establish flagship programs within its campuses, subject to the guidelines and policies issued by the CHED and the approved internal guidelines and policies of BulSU. The establishment of these flagship programs shall be in accordance with the strategic development plans of BulSU and shall aim to promote excellence, innovation, and relevance in higher education. The selection and development of flagship programs shall be based on thorough research, consultation with relevant stakeholders, and alignment with the priorities of the university and the national development agenda.

SEC. 3. Other Campuses. - The University may establish such other campuses such as satellite, virtual or external as may be determined and approved by the Governing Board.

Rule VI

GENERAL MANDATE AND CURRICULAR OFFERINGS

SEC. 1. General Mandate. - The BulSU shall primarily provide advanced education, higher technological, professional courses and training programs in engineering and technology, arts and sciences, education, agriculture and industrial fields, accountancy, business and public administration, medicine and allied health courses, hotel and restaurant management, tourism, aeronautics, artificial intelligence and robotics, law, nontraditional courses and other relevant fields of study. It shall also undertake research and extension services and production activities, in support of the socioeconomic development of the Province of Bulacan and Central Luzon Region.

SEC. 2. Curricular Offerings. - The BulSU shall primarily offer undergraduate and graduate courses, advanced professional and technical instruction and training within its areas of specialization in the fields of environment and natural sciences, accountancy, commerce, business and public administration, agriculture, education, fisheries, forestry, engineering and technology, arts and sciences, law, medicine and allied medicine, architecture, archeology, hotel and tourism, aeronautics, artificial intelligence and robotics, public administration, lifelong learning.adult education and other relevant fields of study, as the Board of Regents may deem necessary for the accomplishment of its objectives, and those which respond to the human resource development needs of the Province of Bulacan and Central Luzon Region: Provided, That BulSU shall comply with the policies, standards and guidelines of the CHED for the offering of courses and the introduction of new or revised programs.

SEC. 3. The BulSU may open new branches or extension campuses in consortium with other academic institutions as it may deem necessary, to improve access to quality education, promote innovation and progress in the academe, and advance its research capabilities, subject to applicable arrangements with other institutions: Provided, That BulSU shall comply with the policies, standards and guidelines of the CHED for the operation of regular or extension campuses.

SEC. 4. The existing reasonably-sized laboratory junior and senior in high school shall continue to operate under the supervision of the College of Education of the BulSU to serve the in-campus requirements of its students, which shall be limited in number to correspond the available funds, including the capacity and resources.

RULE VII

THE GOVERNING BOARD (GB)

SECTION 1. The Governing Board. - The governing board of the BulSU shall be the Board of Regents, hereinafter referred to as the GB, which shall be chaired and co-chaired by the Chairperson of the CHED and the President of the BulSU, respectively, and with the following as members:

(a) Chairperson of the Committee on Higher, Technical and Vocational Education of the Senate;

(b) Chairperson of the Committee on Higher and Technical Education of the House of Representatives;

(c) Regional Director of the National Economic and Development Authority (NEDA);

(d) Regional Director of the Department of Agriculture;

(e) Regional Director of the Department of Science and Technology;

(f) President of the federation of faculty associations of the BulSU;

(g) President of the federation of student councils of the BulSU;

(h) President of the federation of alumni associations of the BulSU;

(i) President of the nonteaching personnel association of the BulSU; and

(j) Two (2) prominent citizens from the private sector who have distinguished themselves in their professions or fields of specialization, selected from the list of at least five (5) qualified persons from the Province of Bulacan, as recommended by the search committee constituted by the President of BulSu, in consultation with the Chairperson of the CHED and other members of the Board, based on the guidelines, qualifications, and standards for the position set by the Board, and who shall serve for two (2) years from their date of appointment.

The President of the federation of faculty associations, the President of the federation of student councils, the President of the federation of alumni associations, and the President of the non-teaching personnel association of the BulSU shall be coterminous with their terms of office, as provided under their respective constitutions and bylaws.

In case of hold-over capacity of any member from the federation of faculty associations of the BulSU, federation of student councils of the BulSU, federation of alumni associations of the BulSU, President of the nonteaching personnel association, the duration of hold-over capacity must not exceed six (6) months from the expiration of his/her term notwithstanding any contrary provision in their existing Constitution and By-laws. Failure to elect the concerned member's representative shall thereafter place the member in an observer capacity in the Board's meetings without any power to participate in its deliberations, including the power to vote and exercise other powers and duties as member of the GB, until it has elected its neew representative. In case the Student Councils of BulSU and/or Faculty Associations of BulSU are not federated, they/it shall be granted a period not exceeding one (1) year from the effectivity of this IRR to ensure full compliance with the mandatory requirement of Republic Act 11980. This transition period is afforded to new duly elected set of officers who will serve upon the effectivity of RA 11980 in order to facilitate the necessary adjustments, amendments, or reforms within the Constitution and By-laws of the Student Councils and the Faculty Associations to align their structures, functions, and operations with the requirements outlined in R.A. 11980. Failure to establish a federation within the transition period, the Student Representative (SR) and Faculty Representative (FR) shall be placed in an observer capacity in the board meetings of the GB without any power to participate in its deliberations, including the power to vote and to exercise other powers and duties of a member of the GB.

SEC. 2. Powers and Duties of the Governing Board. - The administration of the BulSU and the exercise of its corporate powers are vested in the Board, which shall have the following specific powers and duties in addition to its general powers of administration and the exercise of all the powers granted to the Board of Directors of a Corporation under Section 35 of Republic Act No. 11232. The Board shall have the following specific powers and duties:

a. Promulgate and implement guidelines in accordance with the declared State policies on education, other pertinent provisions of the Constitution on education, agriculture, science and technology, and the policies, standards and thrusts of the CHED under Republic Act No. 7722, otherwise known as the "Higher Education Act of 1994";

b. Approve the curricula, instructional programs, and rules on student discipline drawn by the Administrative and Academic Councils as herein provided;

c.

Appoint, upon the recommendation of the President of the BulSU, the vice presidents, deans, directors, heads of the campuses, faculty members, and other officials of the BulSU;

d. Prescribe the salaries of faculty members and administrative officials and employees, subject to the provisions of Republic Act No. 11466, otherwise known as the "Salary Standardization Law of 2019", civil service rules and regulations governing hours of service and such other requirements and conditions, and other pertinent laws, rules and regulations;

e. Fix the tuition fees and other necessary school charges, such as matriculation fees, graduation fees and laboratory fees, as the Board may deem proper to impose, after due consultation with the concerned sectors. The fees and charges, including government subsidies and other income generated by the BulSU, shall constitute its funds to be used exclusively in the pursuit of the mandate as a state university, and shall be deposited in any authorized government depository bank. All interests that shall accrue therefrom shall form part of the same funds for the use of the BulSU;

The fees and charges collected by the BulSU, including government subsidies and proceeds from other income sources, as well as interests that would accrue therefrom, shall be retained by the University: Provided, That in no case shall the said income be used for the payment of allowances and other benefits not authorized by law: Provided, further, That all fiduciary fees shall be disbursed for the specific purposes for which they were collected.

If the BulSU, for reasons beyond its control, would not be able to pursue any project for which funds have been appropriated and allocated under its approved program of expenditures, the Board may authorize the use of said funds for any reasonable purpose for which it deems necessary and urgent for the attainment of the objectives of the University: Provided, That funds collected from students for specific purposes shall not be realigned or reprogrammed to other expenditures;

f. Adopt and implement a socialized scheme of tuition and other school fees for greater access of poor but deserving students in accordance with Republic Act No. 10931, or the "Universal Access to Quality Tertiary Education Act";

g. Establish professional chairs in the BulSU and provide fellowships for qualified faculty members, and scholarships to deserving students;

h. Receive and appropriate sums as may be provided by law for the support of the BulSU, and all other sums in the manner it may, in its discretion, determine to carry out the purposes and functions of the BulSU;

i. Set the policies on admission and graduation of students;

j. Award honorary degrees upon persons in recognition of their outstanding contributions in the fields of education, public service, arts, science and technology, sports and human kinetics or any field of specialization within the academic competency of the BulSU, and authorize the awarding of certificates of completion of nondegree and nontraditional courses;

k. Establish research and extension centers to promote the development of the BulSU;

l. Develop academic arrangements for institutional capacity building with appropriate institutions and agencies, whether public, private, local or foreign, and appoint experts or specializes as consultants, part-time, visiting or exchange professors, scholars or researchers, as the case may be;

m. Adopt modern and innovative modes of knowledge transfer for the promotion of greater access to education such as the use of information technology, the dual training system, open distance learning, and community laboratory;

n. Collaborate with the governing bodies of other state universities and colleges within the Province of Bulacan and Central Luzon Region, under the supervision of the CHEd and in consultation with the Department of Budget and Management (DBM), in restructuring the BulSU to make it more efficient, relevant, productive and competitive;

o. Absorb non-chartered tertiary institutions within the Province of Bulacan and Central Luzon Region as branches, extension or external centers, in coordination with the CHED and in consultation with the DBM, and offer therein programs or courses to carry out the constitutional mandate of providing equal access of students to educational opportunities;

p. Authorize an external management audit of the BulSU, to be financed by the CHED, subject to the rules and regulations of the Commission on Audit, and institute reforms, including academic and structural changes, on the basis of the audit results and recommendations;

q. Develop consortia and other economic forms of linkages with local government units as well as public, private, local or foreign institutions and agencies for the furtherance of the purposes and objectives of the BulSU;

r. Import books or publication, instruments, equipment and apparatuses for economic, technical-vocational, scientific, medical, philosophical, historical, legal or cultural purposes;

s. Enter into joint ventures with business and industry, after consultation with the NEDA, for the profitable development and management of economic assets, the proceeds of which shall be used for the development and strengthening of the BulSU;

t. Receive, in trust, all legacies, gifts and donations of real and personal properties of all kinds and administer and dispose of the same, when necessary, for the benefit of the BulSU and subject to the limitations, directions and instructions of the donor, if any;

u. Extend the term of the President of the BulSU beyond the age of retirement, bot not beyond the age of seventy (70), based on the guidelines, qualifications and standards set by the Board: Provided, That such extension shall be subject to the term limits provided in Section 10 of this Act: Provided, further, That the President's performance has been rated by the Board as outstanding and a unanimous recommendation for such extension has been decided upon by the search committee;

v. Delegate any of its powers and duties provided to the President and other officials of the BulSU, as it may deem appropriate, so as to efficiently and effectively administer the affairs of the BulSU;

w. Establish policy guidelines and procedures for participative and transparent decision-making within the BulSU;

x. Where most advantageous to the BulSU, outsource the management of nonacademic services such as health, food, building or grounds or property maintenance, and such other similar activities;

y. Authorize the construction or repair of its buildings, machinery, equipment and other facilities, and the purchase and acquisition of real property, including the necessary supplies, materials, and equipment; and

z. Promulgate rules and regulations, as may be necessary, to carry out the purposes and functions of the BulSU.

RULE VIII

BOARD MEETING

SECTION 1. Meetings of the Board. -

a. Regular Meetings. The GB shall regularly convene once every three (3) months.

b. Special Meetings. The Chairperson of the GB may however, call a special meeting whenever necessary, provided that members are notified in writing at least three (3) days prior to the conduct of said meeting.

SEC. 2. Quorum. - The quorum of the GB shall consist of majority of all its members holding office at the time of the meeting: Provided, however, That the Chairperson of the GB or the President of the BulSU is among those present in the meeting.

In case of failure to constitute a quorum, the meeting shall be terminated and scheduled on a later date.

SEC. 3. Presiding Officer. - The CHED Chairperson shall be the Presiding Officer of all regular and special meetings of the BulSU Governing Board. However, the Chairperson of the CHED is hereby authorized to designate a CHED Commissioner as the regular Chairperson of the GB, in which case, the said CHED Commissioner shall act as the Presiding Officer.

This, notwithstanding, in the absence of the CHED Chairperson or the CHED Commissioner designated as the regular Chairperson in a meeting of the GB, the CHED Chairperson may designate another CHED Commissioner as his/her representative in the same meeting, where said representative shall have all the rights and responsibilities of a regular member. During the said meeting, however, the President of BulSU, as Co-chairperson, shall be the presiding officer.

SEC. 4. Proxy Members. - In case of failure of the CHED Chairperson to be present, a Commissioner of the CHED, duly designated by the CHED Chairperson as representative in the meeting, shall have all the rights and responsibilities of a regular member: Provided, That during the meeting, the President of the BulSU, as Vice-Chairperson of the CHED may designate a CHED Commissioner as the regular Chairperson of the Board, in which case, the said CHED Commissioner shall act as the presiding officer.

In case the Chairperson of the Senate Committee on Higher, Technical and Vocational Education and Technical Education will not be able to attend the Board meeting, they may designate in writing their respective representatives to attend the meeting, who will have the same rights and responsibilities as a regular member of the Board.

In case of a proxy appointed by other members of the Governing Board in writing, the duly appointed proxy shall possess equivalent powers and responsibilities as those of a regular member of the Board.

SEC. 5. Compensation. - The members of the Board shall not receive any salary, but shall be entitled to reimbursement for actual and necessary expenses incurred, either for their attendance in the meetings of the Board or in connection with other official business authorized by resolution of the Board, subject to existing laws and regulations.

SEC. 6. Entitlement of Honorarium of the Members of the Governing Board. - The Chairperson, Vice-Chairperson and Members of the GB may be entitled to honorarium in their attendance during meetings of the GB in accordance with DBM guidelines and existing accounting and auditing rules and regulations.

The resource person and the Committee duly constituted by the GB shall likewise be entitled to honorarium in their attendance during meetings and such other incidental activities: Provided, that the rate of honorarium shall be in accordance with the guidelines promulgated by the Department of Budget and Management (DBM) and such other relevant issuances thereof.

SEC. 7. Approval of Urgent Resolutions Through Referendum. - The University President or any member of the GB may propose urgent resolutions via referendum concerning matters crucial to fulfilling the mandate, vision, mission, and objectives of BulSU, ensuring continuity in service delivery that necessitates immediate action before the regular or special en banc meeting. Provided, that such resolution shall be signed by an affirmative majority of the GB: Provided further, that the University President shall sign such resolution before the same be toured to the Chairperson of the GB. The resolution holds the same legal weight as if approved by the majority of the members of the Board holding office at the time of the referendum.

RULE IX

THE PRIVATE SECTOR MEMBERS

SECTION 1. Search Committee. - The President of BulSU, in consultation with the Chairman of the CHED and other members of the GB, shall establish a Search Committee (SC) responsible for recruiting, screening, and recommending at least five (5) distinguished individuals from the Province of Bulacan to the GB for possible appointment.

SEC. 2. Composition of the Search Committee. - The SC established and constituted by the President of the BulSU with prior approval of the CHED Chairman shall consists of three (3) members, one (1) from the student sector, one (1) from private sector and one (1) from faculty sector, who will select their Chairperson from within the committee.

SEC. 3. Minimum Qualifications and/or Standards for Private Sector Representatives in the GBs. - Any persons cannot serve as a member of the GB representing the private sector for BulSU unless he/she meets all the qualifications and standards established by the GB such as:

a) Be a Filipino citizen and of legal age;

b) From an industry, business, or profession preferably related to the SUC's charter or mandate;

c)

Have at least five (5) years of employment, business, or practice of profession in the private sector;

d) Be domiciled in or a resident for at least two (2) years of the city or province where the sue or its campuses are located;

e) Not connected with the SUC concerned or other government agencies and instrumentalities in any manner, for one (1) year immediately prior to his or her nomination to the Private Sector Representative (PSR) position;

f) Not currently employed or appointed to any position in the government (local, national, including government-owned and controlled corporations), be it full time or part time, at the time of nomination for the PSR position;

g) Not related to any member of the present Board or their duly-authorized representatives, within fourth civil degree of consanguinity or affinity;

h) Not have been a candidate who lost in any national or local election, except for barangay elections, within one (1) year after such election; and

i) Must be a person of unquestionable integrity and probity and must not have been convicted of any offense (administrative, civil, or criminal).

The GB reserves the authority, through a majority vote, to introduce supplementary qualifications or additional requirements for determining the eligibility of the two (2) prominent citizens from the private sector to serve as members of the GB.

SEC. 4. Results of search. - The SC shall present and submit a list of at least five (5) nominees to the GB within thirty (30) days from the commencement of its search, following the procedures of its search, following the procedures established by the SC.

SEC. 5. Selection. - The GB will choose the two (2) private sector representatives from the pool of five (5) individuals recommended/nominated by the SC, carefully taking in consideration the qualifications of each candidate and the potential impact of their knowledge, expertise, and breadth of experience on the GB's deliberations and BulSU's mission as an educational institution.

SEC. 6. Appointment. - Upon the selection of the two (2) private sector representatives by the GB, their appointment shall be approved by virtue of a Resolution duly passed by the GB. Said appointment shall be signed by the GB Chair, whether CHED Chair or Commissioner.

SEC. 7. Assumption. - By virtue of the said appointment, the two (2) private sector representatives shall commence their duties subsequent to taking oaths before either the CHED Chairman or the CHED Commissioner, acting as the Chair of BOR, or before his duly designated representative. The private sector representatives must take their oaths of office before they could assume as GB members.

SEC. 8. Terms of Office. - The private sector representatives shall serve for a period of two (2) years from the date of appointment. They may be re-appointed for another term subject to the satisfaction of the criteria determined and approved by the GB.

SEC. 9. Disciplining Authority and Measures. - In accordance with the provisions herein, it is established that since the Private Sector Representative is appointed by the members of the GB, it holds explicit disciplining authority on members who committed any misconduct, negligence, or actions contrary to the best interests of the BulSU, encompassing measures such as reprimand, suspension, or removal from office with due process of law. The authority is vested in the GB to ensure the maintenance of organizational integrity, effectiveness, and alignment with its objectives, empowering it to take decisive action to uphold transparency, accountability, and the highest standards of governance within the organization.

RULE X

THE PRESIDENT OF THE FEDERATION OF STUDENT COUNCILS

SECTION 1. President of the Federation of Student Councils of the BulSU. - The student representative duly elected by the presidents of the student council who are all members of the Federation of Student Councils shall be known as the Student Regent (SR).

SEC. 2. Assumption. - Once the President of the Federation of Student Councils of the BulSU is duly elected, he/she shall commence his-her duties subsequent to taking his/her oath of office.

SEC. 3. Term of Office. - The term of the president of the Federation of Student Councils as a member of GB shall be coterminous with his/her term of office in such capacity in accordance with their respective Constitution and by-laws. Provided, however, that if the president of the Federation of Student Councils loses his/her status as a student due to graduation from BulSU, dismissal, transfer, or such other causes, the rule on order of succession as embodied in its Constitution and By-laws shall be applied and shall then serve for the remaining terms as a regular member of the GB.

RULE XI

THE PRESIDENT OF THE FEDERATION OF FACULTY ASSOCIATIONS

SECTION 1. President of the Federation of Faculty Associations of the BulSU. - The faculty representative duly elected by bona fide members of the duly registered and recognized faculty associations who are all members of the Federation of Faculty Associations at BulSU shall be known as the Faculty Regent (FR).

SEC. 2. Assumption. - Once the president of the Federation of Faculty Associations of the BulSU is duly elected, he/she shall commence his/her duties subsequent to taking his/her oath of office.

SEC. 3. Term of Office. - The term of the president of the Federation of Faculty Associations as a member of GB shall be coterminous with his/her term of office in such capacity in accordance with their respective Constitution and by-laws. Provided, however, that if the president of the Federation of Faculty Associations loses his/her status as a faculty due to dismissal, transfer, death, incapacity to perform his/her sworn duties or such other causes, the rule on order of succession as embodied in its Constitution and By-laws shall be applied and shall then serve for the remaining term as a regular member of the GB.

RULE XII

THE PRESIDENT OF THE FEDERATION OF ALUMNI ASSOCIATIONS

SECTION 1. President of the Federation of Alumni Associations of the BulSU. - The alumni representative duly elected by the presidents of the duly recognized local alumni associations who are all members of the Federation of Alumni Associations at BulSU shall be known as the Alumni Regent (AR).

SEC. 2. Assumption. - Once the president of the Federation of Alumni Associations of the BulSU is duly elected, he/she shall commence his/her duties subsequent to taking his/her oath of office.

SEC. 3. Term of Office. - The term of the president of the Federation of Alumni Associations as a member of the GB shall be coterminous with his/her term of office in such capacity in accordance with their respective Constitution and by-laws. Provided, however, that if the president of the Federation of Alumni Associations loses his/her status as a member due to dismissal, transfer, death, incapacity to perform his/her sworn duties or such other causes, the rule on order of succession as embodied in its Constitution and By-laws shall be applied and shall then serve for the remaining term as a regular member of the GB.

RULE XIII

THE PRESIDENT OF THE NONTEACHING PERSONNEL ASSOCIATION

SECTION 1. President of the Nonteaching Personnel Association. - The nonteaching personnel representative duly elected by its members shall be known as the Nonteaching Personnel Regent )NPR). The nonteaching personnel association must be duly recognized and registered before the Civil Service Commission, BulSU and other concerned agencies.

SEC. 2. Assumption. - Once the president of the Nonteaching Personnel Associations of the BulSU is duly elected, he/she shall commence his/her duties subsequent to taking his/her oath of office.

SEC. 3. Term of Office. - The term of the president of the president of the Nonteaching Personnel Association as a member of GB shall be coterminous with his/her term of office in such capacity in accordance with their respective Constitution and by-laws. Provided, however, that if the president of the Nonteaching Personnel Association loses his/her status as a member due to dismissal, transfer, death, incapacity to perform his/her sworn duties or such other causes, the rule on order of succession as embodied in its Constitution and By-laws shall be applied and shall then serve for the remaining term as a regular member of the GB.

RULE XIV

THE UNIVERSITY PRESIDENT

SECTION 1. The University President. - BulSU shall be headed by a President who shall be appointed by the Board, subject to its guidelines, qualifications and standards, and based on the recommendations and standards, and based on the recommendation of a search committee duly constituted for the purpose of selecting the President. The University President, being the head of the university, is primarily tasked to diligently, responsibly, and competently oversee the daily operations of the BulSU. This includes implementing the policies, guidelines, and programs established and delegated by the GB. Additionally, the President is responsible for striving to achieve the academic objectives of BulSU, which are aligned with its Vision, Mission, Goals, and Objectives.

SEC. 2. Appointment and Term of Office. - After the GB shall have selected and appointed the University President by a majority vote of the members present in a meeting called for the purpose, his/her appointment papers shall be signed by the CHED Chairperson or the CHED Commissioner duly designated as Regular Chair of the GB.

The University President appointed by the Board shall have a term of four (4) years, the beginning and end of which must be clearly specified in the appointment by the Board. The University President shall be eligible for reappointment for another term: Provided, That he/she must at least obtain a very satisfactory performance rating and secure a majority vote from the members of the GB.

SEC. 3. Powers and Duties. - The powers and duties of the President of the University, in addition to those specifically provided in this Act, shall be those usually pertaining to the Office of the President of similar universities, and those delegated by the GB such as but not limited to the following:

a. To provide leadership for the University, to preserve and protect its academic integrity and ensure the observance and implementation of the policies laid down by the Board of Regents;

b. To exercise within the framework of university policies primary authority and responsibility over the following areas: development planning and resource allocations; grants; endowments and fund raising; external relations and public affairs; ad university policies relating to regional developmental programs, curricula and matters affecting the rights, privileges, responsibilities and welfare of the university constituency;

c.

To formulate integrated and comprehensive plans for the university including academic, research, extension, physical development and fiscal plans;

d. To coordinate the activities and programs of the University with the other component units and institutions, appraise their performance in relation to goals and recommend appropriate action to the Board of Regents;

e. To appoint officers, faculty members and other employees in the University subject to Section 8 of this Act and to designate deans, directors, heads of departments/offices, or officers-in-charge of the units therein;

f. To appoint, transfer or promote personnel of the University as herein below provided; fix their work schedule; grant leaves of absence; approve their special detail, additional assignments, additional compensational resignation and retirement in accordance with the policies approved by the Board of Regents;

g. To set up a machinery for the review of all disciplinary actions appealable to the office of the president and for the consideration of petitions of redress grievances;

h. To submit to the Board of Regents the courses of study and academic programs, rules and discipline and awards of degrees and diplomas as recommended by the university council;

i. To award fellowships, assistance and scholarships to students, faculty members and other personnel in accordance with the policies prescribed by the Board of Regents;

j. To plan, prepare and implement a university program for the training and education of adult citizens and out-of-school youths;

k. To negotiate and obtain grants for specific projects, gifts and donations of real or personal property of all kinds subject to the confirmation of the Board of Regents, and to administer the same for the benefit of the University, its units, departments, or students in accordance with the directions and instructions of the donor, and in default thereof, in such manner as the Board of Regents may, in its discretion, determine;

l. To maintain links with other academic and research institutions to ensure fruitful academic and technical interchange and maximize the use of human and physical resources;

m. To prepare for approval of the Board of Regents the annual budget of the University;

n. To submit to the Board of Regents annual reports on the operation of the University, and such other reports as the latter may require under this Act; and

o. To exercise such other powers and discharge such other responsibilities as may be delegated to him by the Board of Regents: Provided, That he shall institute a system for the efficient discharge of his administrative responsibilities.

SEC. 4. Minimum Qualifications. - The minimum qualifications of any applicant for the BulSU Presidency shall be:

a. Not less than thirty-five (35) years old and not a day older than the sixty-first (61st) birthday at the time of the expiration of the term of the incumbent President;

b. A Filipino citizen;

c.

Holder of an earned doctorate degree from a CHED-recognized HEI or foreign institution accredited by its respective higher education ministry/commission or appropriate regulatory body, which is defined as Level 8 in the Philippine Qualifications Framework (PQF), under RA No. 10968;

d. With proven track record as State Universities and Colleges / Local Universities and Colleges administrator (e.g., president, vice-president, dean, campus administrator, director) or high-level management executive/administrator, whether in the public or private sector, for at least five (5) years; Nomenclature of the position, especially in the private sector may be clarified by the GB as long position in high-level management; and

e. Must not have been convicted for a crime involving moral turpitude, or an offense punishable by imprisonment for a period exceeding six (6) years, or suspended administratively for twelve (12) months, or dismissed from the service.

For SUC Presidents who are undergoing evaluation for a second term, he/she must not have been convicted of any administrative offense or crime.

An application who does not meet any one of the above-mentioned minimum qualifications and cannot submit pertinent supporting documentary evidences shall be disqualified from the search process.

The BulSU GB may set additional minimum qualifications it deem fit.

SEC. 5. Documentary Requirements for the Application for President. - Interested applicants must submit one (1) set of original and six (6) certified true copies of the following documents to the Search Committee for Presidency (SCP) Secretariat:

a. Formal application letter addressed to the BulSU GB Chairperson;

b. Detailed curriculum vitae, attested and signed by the applicant;

c.

Transcript of records, training certifications, professional accreditations, diplomas, and employment/service records;

d. Published research work, if any;

e. Signed and notarized statement containing the Proposed Vision, Mission, and Development Goals for the BulSU;

f. Certificates/clearances from the following government agencies, obtained no more than three (3) months from the filing date of the application, indicating that the applicant has not been found guilty in any administrative or criminal case:

g. PSA-authenticated Birth Certificate

h. Medical Certificate of Physical Fitness issued by a physician from CHED-recognized accredited health institutions but not the same institution where applicant is presently employed

i. Results of Neuro-psychiatric examination conducted by a physician from CHED-recognized accredited health institutions but not the same institution where applicant is presently employed

j. Duly accomplished CSC Form 212 made under oath

The SCP Secretariat shall check the completeness of the required documents and shall make their initial report to the SCP. Should the SCP find that there are applicants who lack necessary documents, the SCP must immediately refer to the GB whether or not the applicants will be advised to complete the documents and continue with the process.

SEC. 6. Criteria for Evaluation. - In general, applicants for SUC presidency shall be evaluated on four (4) major areas:

a. Professional Competencies - 35%;

b. Academic background -25%;

c. Public Forum/Presentation - 25%; and

d. Panel interview - 15%

SEC. 7. Constitution of the Search Committee. - Within six (6) months before the expiration of the term of office of the incumbent President of the University, the GB shall constitute the Search Committee for Presidency (SCP).

SEC. 8. Succession. - In case of vacancy by reason of death, resignation, removal for cause, or incapacity of the incumbent SUC President to perform the functions of office, the GB shall, within five (5) calendar days from the occurrence of such vacancy, designate an Officer-in-Charge with the same qualifications as the President. In the event of unavailability of the majority of the members of the GB to hold a Special Meeting for this purpose, the Chairperson of the GB may designate an OIC President, subject to the confirmation by the GB in a meeting set for this purpose. If GB did not ratify/confirm the designated OIC President, the GB may designate another OIC President, subject to CSC Rules on designation.

Within six (6) months from the appointment of the OIC President, the GB shall constitute the Search Committee for the President.

The OIC President shall not be allowed to vote in the selection of the SUC President. The OIC President however, may be allowed to apply as SUC President in the same SUC that he is currently serving, provided that he/she relinguishes the OIC designation as soon as the Search Committee is constituted.

SEC. 9. Remuneration. - The salary of the President of the BulSU shall be in accordance with Republic Act No. 11466 or the "Salary Standardization Law of 2019", and such other laws, mandatory thereto, which may hereinafter be enacted, and shall be comparable to that being received by the presidents of similar educational institutions.

The University President shall likewise be entitled to full retirement benefits under existing laws. Furthermore, the President of the University shall be entitled to Representation and Transportation Allowance (RATA) and such other benefits based on the rates prescribed by the DBM.

RULE XV

THE VICE PRESIDENTS, DIRECTORS, HEADS AND OTHER UNIVERSITY OFFICIALS

SECTION 1. Vice Presidents. - The President of the University shall be assisted by an Executive Vice President; a Vice-President for Academic Affairs; a Vice-President for Administration, Planning and Finance; a Vice-President for Research, Development, and Extension; a Vice President for Linkages, Production, and Research Generation; and a Vice President for Quality Assurance, taking into consideration the actual needs, availability of funds and resources of the University. In such case, the University President shall recommend to the GB the appointment of the said University officials in accordance with the minimum qualification standards set by the GB.

This is without prejudice however, to the authority of the President, the Academic and Administrative Councils to recommend the creation/abolition of offices as they may deem necessary subject to the approval of the GB.

The University President, upon the approval of the GB shall issue an appropriate special order to effect designation for Vice-President, Deans, Directors, Heads, and other officials of the University. He/she may likewise designate Officers-in-Charge subject to the rules and regulations set by the GB and in accordance with the guidelines set by the CHED.

SEC. 2. Deans and Campus Directors. - Deans and Campus Directors or Campus Deans, as officially designated or appointed, shall lead or develop educational strategies for their respective colleges or campuses within the University while working in an administrative capacity, overseeing or collaborating with other members of faculty, staff, the student body, and other University stakeholders.

SEC. 3. Duties and Responsibilities. - The University President shall prescribe the duties and responsibilities and oversee the performance of the Vice-Presidents, College Deans, Directors, Heads, Chairpersons and other officials in accordance with the provisions of the University Code approved by the GB and such other existing law, rules and regulations.

SEC. 4. Entitlement of Representation and Transportation Allowance and Honorarium. - The Vice-Presidents, College Deans, and Directors, may be entitled to monthly Representation and Transportation Allowance (RATA) in accordance with the provision of DBM Circulars, rules and regulations: Provided that the Directors and other officials who are not covered by the DBM Circulars, rules and regulations may be granted reasonable honorarium as the University President may prescribe and as duly approved by the BOR, subject to the availability of funds and the usual accounting and auditing rules and regulations: Provided, further, that the amounts necessary to support the grant of RATA and honorarium may be charged from appropriate funds of the University subject to applicable laws, rules and regulations.

SEC. 5. Secretary of the University. - The Board shall appoint a Secretary, who shall serve as such for both the Board and the University whose qualifications may be determined and set by the GB.

The Secretary so appointed shall, among others, keep all the records and the minutes of the proceedings of the GB and shall communicate to the GB Chairperson, Vice-Chairperson, and members of the BulSU GB notice of all regular meetings, special sessions, and other undertakings of the GB. In no case that the Board Secretary is authorized to release any document without prior notice and approval from the University President. In the execution of his/her duties, the Board Secretary is obligated to uphold standards of probity, competence, and integrity at all times.

The University President must ensure, through the Board Secretary, the preparation of the agenda folders for Board Meetings to be provided to the BulSU GB Chairpersons and members at least five (5) days prior to any regular meeting and one day prior to a special session except in matters of paramount importance where the said period may not be observed.

The position of Secretary of BulSU is primarily confidential in nature premised on the close proximity, high degree of trust and confidence between the GB and the Secretary, as well as the nature of his/her function primarily involving sensitive policy matters and confidential deliberations. As such, his/her removal may be grounded on loss of trust and confidence by the GB.

In the absence of the Secretary for a scheduled meeting, an alternate Secretary may be designated by the GB.

SEC. 6. The Treasurer of the University. - The Treasurer of the Philippines shall be the ex-officio treasurer of the University.

SEC. 7. Chancellor, Duties and Responsibilities.

Within authorized designation, Chancellors shall implement policies, plans, and programs concerning organizational, operational, and academic functions of the assigned campus/es of the University, perform direct administration, and oversee the proper execution of these functions. He/She shall:

1. Assist the University Top Management in overseeing the operation of the assigned campus/es in terms of:

a. Instruction;

b. Research;

c. Extension;

d. Students Services;

e. Financial Undertaking; and

f.

Administrative initiatives.

2. Act as the chief academic officer of the University over the assigned campus/es- to implement and operate various programs; to encourage and manage new programs; to improve existing programs; and to sustain educational change and innovation in terms of Instruction, Research, Extension, Student Services, Administration, Finance and other related undertakings.

3. Supervise the college deans or campus deans/directors and all other heads of office under them to ensure that the university's vision, mission, and objectives are accomplished efficiently and effectively.

4. Supervise colleges/campuses in preparing various programs accreditations vital for the University's quality assurance and implementation of outcome-based education; assist in the University's plight for other certifications in producing academic programs as Centers of Development and Centers of Excellence.

5. Ensure the University's policy on faculty loading, estimates of honoraria, faculty workload schedules, tutorial and special classes, and make-up classes, college/campus and university-based activities, permission to teach outside the University, and other related undertakings are implemented accordingly.

6. Ensure that the implementation of the University's faculty and staff development programs is well-communicated to the community and is properly undertaken; ensure that all colleges/campuses have a clear and staff development program.

7. Oversee the implementation of the University's policy on students' welfare and development, including but not limited to Guidance and Counseling, Career Development/Internship, Placement and Employment Services, Organizations, Publications, Licensure Examinations, International Linkages, Sports and Cultural Development, Admissions, Enrolment, Scholarships, and other student-related services.

8. Implement the various research and extension programs and projects of the University.

9. Ensure the colleges/campuses have a defined Research Program aligned with the University's Research Agenda.

10. Guarantee that all faculty members are engaged in the research and extension programs of the University by ensuring that the policy crafted by the Office of the Vice President for Research, Development, and Extension, including but not limited to research-based extension activities, teacher-student collaborations, linkages with other institutions, the initiative for innovations and research publications is attained accordingly.

11. Conduct regular meetings with the college and campus deans/directors and units under his supervision.

12. Submit reports and inform and update the Vice President for Academic Affairs religiously on issues concerning their jurisdiction.

13. Recommend solutions to issues and challenges that concern their office.

14. Promote smooth interpersonal relations and intelligent work experience in the University.

15. Perform other duties and responsibilities analogously, germanely, or related to and implied from the above enumeration of duties and responsibilities as may be assigned by University Top Management.

SEC. 8. Campus Director/Dean; Duties and Responsibilities.

Deans and Campus Directors or Campus Deans, as officially designated, shall lead or develop educational strategies for their respective colleges or campuses within the University while working in an administrative capacity, overseeing or collaborating with other members of faculty, staff, the student body, and other University stakeholders. They shall:

1. Act as the administrator of the college/campus;

2. Ensure the efficient and effective performance of the academic staff of the college/campus;

3. Oversee the development, implementation, supervision, integration, and evaluation of the college/campus' academic degree program and the supporting physical facilities;

4. Coordinate with the Admission Office on the admission of students and implement the selective retention policies;

5. Ensure that the objectives and requirements of the college/campus are satisfied by the degree program;

6. Provide opportunities for faculty development through research, extension, and production undertakings;

7. Review and recommend matters such as recruitment, hiring, promotion, permanency, and severance to the proper body faculty and receive reports from the Department and Program Chairs;

8. Initiate regular meetings with the Department and Program Chairs for continuous integration and improvement of the academic programs of the unit;

9. Supervise, with the help of Department and Program Chairs, the students enrolled in the degree and non-degree programs at the University;

10. Recommend to the Administrative and Academic Council candidates for graduation;

11. Prepare, with Department and Program Chairs, the long-range and short-range plans and programs, college/campus goals and objectives, and general directions; and monitor the implementation of such plans, programs, goals, and objectives;

12. Prepare, in conjunction with the Department and Program Chairs, the College budget proposal for approval and administer this budget after the Board has approved the proposals;

13. Prepare the annual procurement plan for the college/campus in conjunction with the Department and Program Chairs;

14. Establish and monitor the linkages between the College/Campus and other institutions outside the university in coordination with the Department and Program Chairs, Director for Internationalization, and other concerned offices;

15. Prepare a report every semester to present statistics on students and faculty and to provide information on the recent development and accomplishment of the College/Campus;

16. Endorse research and extension proposal to directors of concerned services;

17. Conduct regular meetings with the faculty of the college/campus;

18. Evaluate the performance of the Department and Program Chairs (Principal of the Laboratory High School for the College of Education), the faculty, and coordinators of the college//campus;

19. Initiate the accreditation of the different programs under the college/campus;

20. Perform other duties and responsibilities analogously, germanely, or related to and implied from the above enumeration of duties and responsibilities as maybe assigned by University Top Management.

RULE XVI

THE ADMINISTRATIVE COUNCIL

SECTION 1. Composition, Powers and Duties. - There shall be an Administrative council consisting of the President of the University as Chairperson, and the vice presidents, deans, directors, and other officials of equal ranks as members, whose duty is to review and recommend to the Board, policies governing the administration, management and development planning of the University. The Board and the University Secretary may serve as the secretary of the Administrative Council. He/she shall keep all records and proceedings of the Administrative Council, serve upon each member of the Administrative Council the appropriate notice of meetings, and discharge such other duties and responsibilities as the Administrative Council and/or University may determine.

SEC. 2. Meetings and Quorum. - The University President shall fix the schedule and venue of every meeting of the Administrative Council. A quorum for any meeting of the council shall consist of a majority of the members. A majority of such quorum may decide on any question at the meetings, except those matters that require the affirmative vote of a greater proportion as prescribed by relevant laws, rules and regulations.

SEC. 3. Internal Rules of Procedure. - The Administrative Council shall be constituted by the University President. The duly constituted Council may formulate and promulgate internal rules of procedures to ensure proper and orderly conduct of its business and meetings.

RULE XVII

THE ACADEMIC COUNCIL

SECTION 1. Composition, Powers and Duties. - There shall be an Academic Council to be composed of the President of the university, who shall act as the Chairperson, and all academic staff with the rank of at least an assistant professor, as members.

The Academic Council shall have the power to review and recommend the curricular offerings and rules of discipline of the University, subject to the approval of the Board. It shall fix the requirements for the admission of students, as well as for their graduation and conferment of degrees, subject to the review and approval of the BOR through the President of the University.

It shall have disciplinary power over the students of the University and shall formulate academic policies, rules and regulations on discipline, subject to the approval of the Board.

The Academic Council shall have a Secretary to be designated by the University President among the personnel of the University President among the personnel of the University. The duly designated Secretary shall keep all records and proceedings of the Academic Council, serve upon each member of the Academic Council the appropriate notice of meetings, and discharge such other duties and responsibilities as the Academic Council/University may determine.

RULE XVIII

THE FACULTY

SECTION 1. The Faculty. - The faculty of BulSU shall be comprised of its professors, instructors and lecturers of each college or campus. The members of the faculty shall include the following: University Professors, College Professors, Professors, Associate Professors, Assistant Professors, and Instructors.

SEC. 2. Prohibitions in the Selection of Faculty. - No political belief, gender, preference, cultural or community affiliation, ethnic origin, and religious opinion or affiliation shall be a matter of inquiry in the appointment of faculty members of the university: Provided, that the appointment shall be subject to the guidelines, qualifications and standards set by the Board: Provided, further, that a member of the faculty shall not criticize, vouch for, recruit members in behalf of, preach about any particular church re religious sect.

SEC. 3. Appointment, Compensation and Other Benefits of Faculty Members. - The recruitment and other personnel actions for faculty shall be in accordance with the relevant Civil Service laws and rules on Appointment and other Personnel Actions. Recruitment shall be limited to those who meet the minimum requirements prescribed for the rank.

Faculty members of the University shall be entitled to compensation and other benefits prescribed under existing laws, rules and regulations. They may also be entitled to honorarium for overload services for their actual involvement in research, extension, resource generation and other related programs, projects or activities in accordance with applicable laws, rules and regulations as authorized by the University President and the GB.

To promote inclusivity and support in our academic community, it is mandated for BulSU administration, the Faculty Representative, and the Non-Academic Personnel Representative to work together closely in creating and enforcing policies dealing with mental health issues and improve access to education and BulSU facilities for faculty members with disabilities. This partnership will include frequent discussions and full engagement from both sides, ensuring that the university meets and respects the needs and rights of all faculty, including those facing mental health challenges and disabilities.

SEC. 4. Faculty Sabbatical Leave. - The BulSU may grant sabbatical leave to deserving and qualified faculty for purposes of research or community engagement ranging from three (3) months to one (1) year, subject to the recommendation of the Chancellor and the BulSU President ad upon approval of the Board.

Faculty engaged in long-term sabbatical leave shall be temporarily relieved from their teaching duties to exclusively conduct research, write, and engage in scholarly or professional activities and required to submit a research output published in a reputable journal.

Except in case of one (1) or two (2) days of BulSU sports and/or team building activities, the faculty shall have no engagement in other activities including but not limited to teaching, whether full time or part-time in any modality, whether in BulSU, other institutions or research project collaboration.

In case the faculty has an ongoing research at the time of approval of the sabbatical leave, he/she shall be obliged to terminate his/her participation on the said research before the start of the approved sabbatical leave. The faculty shall submit a sworn affidavit showing his/her withdrawal to the research and/or research collaboration as proof.

Moreover, with the duration of the sabbatical leave, the faculty shall no longer be considered or qualified for paper presentation, seminar, trainings, and other faculty and staff development activities and the life. However, the faculty may be allowed to participate as a lecturer or speaker to seminars or events directly related to his/her study upon the directive of the University. Non-compliance with the aforesaid requirements will result to immediate reimbursement of all salaries, allowances, and benefits necessarily included in the sabbatical leave in full without need of demand.

RULE XIX

THE STUDENTS

SECTION 1. Academic Rights and Sociocivic Welfare Students. - It is hereby mandated that both the GB and the administration of BulSU shall uphold strict compliance with Republic Act No. 10931, commonly referred to as the Universal Free Tertiary Education Act. This entails the provision of necessary measures and resources to ensure the effective implementation of the Act, including but not limited to, facilitating access to free tertiary education for eligible students, addressing administrative requirements, and promoting transparency in the utilization of funds allocated for this purpose. Such compliance shall be a paramount priority for both the GB and the BulSU Administration, reflecting their commitment to the principles of equitable access to education and the advancement of higher learning opportunities for all.

SEC. 2. Student Rights. - The GB and the BulSU Administration are mandated to safeguard and uphold the rights of student in accordance with the Magna Carta of Students, in harmony with existing laws and regulations, This necessitates a commitment to ensuring that student rights are respected, protected, and promoted within the university's jurisdiction, encompassing provisions related to academic freedom, due process, equal opportunities, and other fundamental rights enshrined in the Magna Carta of Students. The GB and the BulSU Administration shall work collaboratively to create an environment that fosters the empowerment and welfare of students, while adhering to legal frameworks that govern student rights and responsibilities.

In the pursuit of fostering an inclusive and supportive academic environment, it is hereby mandated that the BulSU administration and the Student Representative shall collaborate closely in formulating and implementing policies specifically aimed at addressing mental health concerns and enhancing accessibility to education and BulSU facilities for Persons with Disabilities (PWDs). This collaboration shall involve regular consultations and active participation from both parties to ensure that the needs and rights of all students, including those with mental health issues and disabilities, are effectively met and respected within the university community.

RULE XX

VALUES FORMATION, PEACE, EDUCATION ,CULTURAL AND HERITAGE PRESERVATION

SECTION 1. Values Formation. - BulSU is committed to provide excellent values education and necessary trainings to ensure individual character development through values formation. It is the goal of BulSU to nurture individuals for their mental, spiritual, physical, emotional well-being and moral growth, endowed with the qualities essential for sustaining a peaceful and democratic nation society.

SEC. 2. Peace Education. - BulSU shall integrate peace education in fulfilling its mandate to promote understanding, tolerance, and peaceful conflict resolution among its faculty, students, and stakeholders for a peaceful community and contribution to world peace. This initiative aims to foster a culture of peace, respect for human rights, and a commitment to social justice, thereby contributing to the overall development of a harmonious and democratic society.

Towards these ends, BulSU shall implement education which values the dignity of the individual, endeavors to cultivate people, seeks for truth and justice, and honors the public spirit that passes on traditions to create a new culture.

SEC. 3. Culture and Heritage Preservation. - BulSU acknowledges the essential contributions of its faculty, students, and other stakeholders in nation-building and is committed to promote and safeguard their physical, moral, spiritual, intellectual, and social well-being. BulSU also recognizes the fundamental role that educational institutions play in instilling patriotism and nationalism, fostering a love for humanity, respecting human rights, appreciating the contributions of modern and national heroes to the country's historical development, educating about citizenship rights and responsibilities, reinforcing ethical and spiritual values, developing moral character and personal discipline, encouraging critical and creative thinking, expanding scientific and technological knowledge, and promoting vocational efficiency.

SEC. 4. Integration to General Mandate. - To achieve these goals, BulSU, through its general mandate, shall integrate in its curriculum and programs values formation, peace education, and to preservation of cultural heritage to foster patriotism and nationalism, accelerate social progress, and promote comprehensive human development and liberation.

RULE XXI

OTHER MISCELLANEOUS PROVISIONS

SECTION 1. Academic Freedom and Institutional Autonomy. - The BulSU shall enjoy academic freedom and institutional autonomy pursuant to paragraph 2, Section 5 of Article XIV of the Constitution.

SEC. 2. Scholarship Programs and Admission. - The BulSU shall provide scholarship programs and other affirmative action programs to assist poor but deserving students who qualify for admission to the BulSU.

No student shall be denied admission to the BulSU by reason of sex, gender, religion, cultural community affiliation, or ethnic origin, or any other forms of discrimination.

The BulSU, subject to applicable laws, regulations, and policies, and contingent upon the availability of funds, may offer and provide scholarships to deserving faculty and non-academic personnel. The eligibility criteria, selection process, and term of these scholarships shall be determined by BulSU GB in accordance with its established guidelines and procedures. This provision aims to recognize and support the academic and professional development of its employees, ensuring equitable access to educational opportunities within the the institution.

SEC. 3. Loan or Transfer of Supplies, Apparatuses, or Equipment, or Detail or Personnel to the BulSU. - Heads of national government agencies and instrumentalities may, upon the request of the Board through the President of the BulSU, loan or transfer supplies, apparatuses, or equipment, or detail personnel to the University: Provided, that such loan, transfer or detail shall not be detrimental to public service.

The personnel to be detailed to the University shall perform such duties as may be deemed required by the President of the BulSU and the time spent for such duties shall be counted as part of the detailed personnel's regular service.

SEC. 4. Assets, Liabilities, and Personnel. - All assets, both real and personal, personnel and records of the BulSU, as well as its liabilities or obligations, shall remain under the name of the BulSU: Provided, That the positions, rights, and security of tenure of faculty members and and personnel therein employed under existing laws shall be respected: Provided, further, That the incumbents occupying the positions shall remain in the same status until otherwise provided for the by the GB: Provided, finally, That the BulSU shall also accordingly upgrade or increase its human resource component as may be deemed appropriate by the GB.

All parcels of land belonging to the government occupied by the BulSU and all its campuses are hereby declared as property of the BulSU and shall be titled under its name: Provided, That should BulSU cease to exist or be abolished or should such aforementioned parcels of land be no longer needed by the BulSU, the same shall revert to the concerned local government units or to the Province of Bulacan or to the Republic of the Philippines, as the case may be.

SEC. 5. Duty and Tax Exemptions. - The imposition of books or publications, instruments, equipment and apparatuses which are for economic, technical-vocational, scientific, medical, philosophical, historical, legal or cultural purposes made by the BulSU, upon certification by the CHED, shall be exempt from the customs duties in accordance with the provisions of Republic Act No. 10863, otherwise known as the "Customs Modernization and Tariff Act".

All grants, bequests, endowments, donations, and contributions made to and used actually, directly, and exclusively for educational purposes by the BulSU shall be exempt from donor's tax and the same shall be considered as allowable deductions from gross income for purposes of computing the taxable income of the donor in accordance with the provisions of the National Internal Revenue Code of 1997, as amended.

SEC. 6. Development Plan, Management Audit, and Organizational, Administrative and Academic Structure. - Within a period of one hundred twenty (120) days after the approval of this Act, the BulSU shall accomplish the following:

(a) Submit a five (5)-year development plan, including its program budget to the CHED for recommendation to the DBM;

(b) Set up its organizational, administrative, and academic structure, including the appointment of key officials of the BulSU; and

(c) Undergo a management audit in coordination with the CHED.

SEC. 7. Annual Report. - On or before the fifteenth (15th) day of the second (2nd) month after the opening of regular classes each year, the GB shall file a detailed report on the progress, condition, and needs of the BulSU with the Office of the President of the Philippines and both Houses of Congress, through the Chairperson of the CHED.

RULE XXII

FINAL PROVISIONS

SECTION 1. Suppletory Application. - The provisions of Republic Act No. 8292, otherwise known as the "Higher Education Modernization Act of 1997", shall form part of this Act.

SEC. 2. Appropriations. - The amount necessary to carry out the initial implementation of this Act shall be charged against the current year's appropriation of the BulSU, Thereafter, such sums as may be necessary for the continued implementation of this Act shall be included in the annual General Appropriations Act.

SEC. 3. Parity Clause. - All other powers, functions, privileges, responsibilities, and limitations under existing laws shall be deemed granted to or imposed upon the BulSU and its officials, whenever appropriate.

SEC. 4. Separability Clause. - If, for any reason, any part or provision of this Act is declared invalid or unconstitutional, the remaining parts or provisions not affected shall remain in full force and effect.

SEC. 5. Repealing Clause. - Republic Act No. 7665, entitled "An Act Converting the Bulacan College of Arts and Trades in the Province of Bulacan into a State University to be known as the Bulacan State University, and Appropriating Funds Thereafter", and other laws, presidential decrees, executive orders, and rules and regulations contrary to or inconsistent with the provisions of this Act are amended, repealed, or modified accordingly.

SEC. 6. Effectivity Clause. - This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
