[ PHILRACOM RESOLUTION NO. 12-10, S. OF 2010, May 19, 2010 ]

AMENDMENTS TO PR 46.5 OF THE RULES AND REGULATIONS OF HORSERACING

WHEREAS, the Philippine Racing Commission (Philracom) has the exclusive jurisdiction and control over the conduct of horseracing including the framing and scheduling of races, the construction and safety of horse-racing, the allocation of prizes and the security of racing as provided in Presidential Decree No. 420;

WHEREAS, consistent with the said mandate, the Philracom feels the need to amend PR 46.5 of the Rules and Regulations on Horseracing because there were previous instances where jockeys of winning horses were overweight after the race and the two (2) racing Clubs differ in the interpretation of the said provision in that the Philippine Racing Club Inc. (PRCI) does not impose penalty on the winning jockey while the Manila Jockey Club Inc. (MJCI) imposes a fine;

WHEREAS, to be consistent, the Regulation and Licensing Division of the Philracom has proposed that the following amendments be made to PR 46.5 of the Rules and Regulations on Horseracing to read as follows:

FIRST OFFENSE SECOND OFFENSE THIRD OFFENSE

a. 1 kg and less Php 1,000 Php 2,000 PHILRACOM pleasure

b. 1.01 kg and 1.50 less Php 2,000 Php 4,00 PHILRACOM pleasure

c. 1.51 kg and 2.00 less Php 2,000 Php 4,000 PHILRACOM pleasure

d. 2.01 kg and more DISQUALIFICATION

WHEREAS, it was further requested that the said amendments to PR 46.5 be approved by the Philracom Board;

NOW THEREFORE, the Philracom Board resolves, as it has hereby resolved, that PR 46.5 be amended as follows:

FIRST OFFENSE SECOND OFFENSE THIRD OFFENSE

a. 1 kg and less Php 1,000 Php 2,000 PHILRACOM pleasure

b. 1.01 kg and 1.50 less Php 2,000 Php 4,000 PHILRACOM pleasure

c. 1.51 kg and 2.00 less Php 2,000 Php 4,000 PHILRACOM pleasure

d. 2.01 kg and more DISQUALIFICATION

RESOLVED FINALLY, that this Resolution effective 15 June 2010 be published in the Kopya and the Official Gazette and be announced in the television for proper guidance of those concerned.
