FURTHER AMENDING MMC ORDINANCE NO. 78-03 ENTITLED "AUTHORIZING TRAFFIC LAW ENFORCEMENT AGENCIES TO TOW AND IMPOUND STALLED MOTOR VEHICLES AND/OR ATTACHMENTS THEREOF IN ANY PUBLIC ROAD, STREET OF THOROUGHFARE WITHIN METROPOLITAN MANILA AND PROVIDING PENALTIES THEREOF", AS AMENDED

WHEREAS, the Metropolitan Manila Development Authority (MMDA), has been implementing MMC Ordinance No. 78-03, as amended by MMA Ordinance No. 3, series of 1992;

WHEREAS, illegal parking vehicle connotes a more deliberate violation on the part of the motor vehicle driver as compared to stalled vehicle violation, wherein loss of the motive power is due to mechanical defect beyond the immediate control of the driver;

WHEREAS, the Metropolitan Manila Council proposed and agreed in session duly assembled to impose a higher penalty [fine] and increase the Towing Fee for illegally parked vehicles, it being a more deliberate and intentional violation and in the interest of enforcing discipline among motorists;

NOW, THEREFORE, pursuant to Section 6 of R.A. 7924, this Regulations is hereby adopted and promulgated by the Council that Sec. 3 of MMA Ordinance, series of 1992 now read as follows:

" Sec. 3 Persons Liable . — Any operator of a public utility motor vehicle or owners or private motor vehicles, whether natural or juridical, which shall stall on any public road, street or thoroughfare within Metropolitan Manila shall pay a fine of Two Hundred (P200.00) Pesos. In addition thereto, a standard towing fee shall be collected by both government and private entities subject to the following rates:

Trucks having gross capacity weight of 4,000 kilos and above P1,200.00 for the first four kms. and P200.00 for every succeeding km. (pt. of reference; impounding area)

Cars, jeeps and pick-ups having gross capacity weight of less than 4,000 kilos

800.00 for the first four kms. and P200.00 for every succeeding km. (pt. of reference; impounding area)

Any driver who shall illegally park his motor vehicle on any public road, street or thoroughfare in Metro Manila, shall pay a fine of FIVE HUNDRED (P500.00) PESOS. In addition thereto, a standard towing fee shall be collected by both government and private entities subject to the following rates:
