Breach of Trust Dismissal for Clerk of Court's Mismanagement of Funds

Court employees who handle judiciary funds occupy a position of public trust. When a clerk of court fails to remit, deposit, or explain court collections, the Supreme Court treats it as a grave betrayal of that trust. In Office of the Court Administrator v. Reyes (A.M. No. P-10-2872, February 24, 2015, 754 Phil. 572), the Court En Banc dismissed Clerk of Court II Emmanuela A. Reyes of the Municipal Trial Court (MTC), Bani, Pangasinan, for gross neglect of duty, dishonesty, and grave misconduct.

A Clerk of Court’s Duty Over Court Funds

Clerks of court are the chief administrative officers of their courts. They collect and safeguard court funds such as the Judiciary Development Fund (JDF), Fiduciary Fund (FF), Special Allowance for the Judiciary Fund (SAJF), Sheriff’s Trust Fund (STF), General Fund, and Mediation Fund. These funds must be deposited promptly and reported faithfully to the Office of the Court Administrator (OCA).

From 2004 to 2009, Reyes delayed remittances of these collections. She likewise failed to deposit, on the day of withdrawal, the interests earned on fiduciary deposits. When asked to explain, Reyes said she presumed nothing was wrong because her collections remained intact. She also cited the 14-kilometer distance to the nearest Landbank branch in Alaminos City. The OCA rejected these excuses, noting that personal travel expenses for official undertakings may be reimbursed and that an accountable officer cannot use distance as a reason for delay.

Unremitted Funds and Unexplained Shortages

Despite earlier corrective measures, the problem continued. Reyes’s salaries were withheld in February 2009 for failure to submit monthly financial reports. They were later released in November 2010 when she complied.
