RESOLUIION

This is a motion filed by respondent praying

for the dismissal of the petition for revlew in the

above-entitled case for failure of petitioner to

appear and prosocute the case.

to tho potitien for review on October 4, l957. On

July l7, l9o0, potitioner requested suspansion of the

hearing of the above-entitlod case until such time as

tho Supreme Court promulgates its cecision on the casa

of People of the Philipptnes vo. William E. Jolliffo

(G. R. No.L-9553). This Court granted petitioner's

motion.

WHEREFORE, finding the instant motion maritcricus.

the game is heroby granted. Let the petitlon for review

in this case be, as it is hereby. dismissed for lack cf

interest sith costt ogainst petitioner.
