Petitioner, -versus- CITY OF MAKATI, CITY Promulgated: MAYOR, AND CITY MAR 1 5 202~ TREASURER, Respondents. x-------------------------------------------------x RESOLUTION On February 14, 2024, the parties filed their Joint Motion for Withdrawal Based on Compromise Agreement praying that the Compromise Agreement dated October 10, 2023 be noted, and, that the present Petition for Review, filed on October 16, 2023, be withdrawn. A perusal of the attached photocopy of the Compromise Agreement shows that it involves various taxable years under different case numbers pending before different courts. Item (b) of the first WHEREAS clause, in relation to paragraph (2), shows that the cases covered by the Compromise Agreement include taxable years 2014 to 2018, docketed as Civil Case No. 20-00177-CV before the Regional Trial Court (RTC) - Makati, Branch 143. Said case was appealed to the Court of Tax Appeals, herein docketed as CTAAC No. 305. WHEREFORE, the parties' Joint Motion for Withdrawal Based on Compromise Agreement is GRANTED. The Petition for Review, docketed as CTA AC No. 305, filed on October 16, 2023 is WITHDRAWN. Accordingly, the instant case is now CLOSED AND TERMINATED.
