ground that the deficiency eatatc tax sought to be collect

ed herein has aiready boen settled through compromise under

the provisions of Section 295 of the National Internal

Revenue Code, as emended, with petitioner paying the amount

f P35.000.00 29 evidenced by BiR Payment Order No. B5153517

and Central Bank Confirmaticn Receipt Mo. S 623i87i, both

dated May 9. 1985. and wi h conformity of counsel for res-

pondent. the said motion is hereby GRANTED.

Aceordingly. iet the petition for review be coneidered

withdrewm and this case deemed closed and termineted.
