MARIANO P. VILLANUEVA, PLAINTIFF AND APPELLEE, VS. MIGUEL BERSES ET AT., DEFENDANTS AND APPELLANTS.
JOHNSON, J.:
REALTY; PUBLIC LANDS.—From the Court of First Instance of Albay. The facts in this ease are analogous to the facts in Valenton vs. Murciano (3 Phil. Rep., 537), which is followed. Judgment affirmed.
Per Johnson, J.
For appellants: Fermin Mariano, and Pedro Concepcion. For appellee: Del-Pan, Ortigas & Fisher.
D E C I S I O N
The facts in this case are exactly analogous to the facts in the case Murciano vs. Valenton, Vol 3. Phil. Rep. 537. Applying the doctrine established in that case to the facts in the present, we are of the opinion and so hold that the judgment of the lower court should be affirmed, with costs, and it is so ordered.
