Janet L. Martinez, appeared. Record shows that this is the second time that petitioner failed to appear for the initial presentation of evidence for the petitioner. Record further shows that petitioner also failed to comply with the Resolution dated October 14, 2009, ordering petitioner to cause the appearance of its new counsel, despite notice. Upon these grounds, counsel for respondent moved that the case be dismissed for failure to prosecute. Finding merit in the motion, the same is hereby GRANTED.
