SUSPENSION FROM THE PRACTICE OF LAW FOR ONE (1) YEAR OF ATTY. AMADO O. IBAÑEZ AND REVOCATION OF HIS NOTARIAL COMMISSION AND DISQUALIFICATION FROM REAPPOINTMENT AS NOTARY PUBLIC FOR ONE (1) YEAR.

For your information and guidance, quoted hereunder is the dispositive portion of the Decision of the First Division dated 15 January 2009 , in Administrative Case No. 7860 entitled, "Avelino Angeles, et at. vs. Atty. Amado O. Ibañez", to wit:

"WHEREFORE, the Court finds respondent Atty. Amado O. Ibañez GUILTY of notarizing the "Extrajudicial Partition with Absolute Sale' : in the absence of the affiant's. Accordingly, the Court SUSPENDS him from the practice of law for one year, REVOKES his incumbent notarial commission., if any, and PROHIBITS him from being commissioned as a notary public for one year, effective immediately, with a stern warning that a repetition of the same or similar offense shall be dealt with more severely"

Respondent received the said resolution per Registry Return Receipt No 896. hi the Resolution dated 1 June 2009 , the Court DENIED with FINALITY the motion for reconsideration of Atty. Amado O. Ibañez.
