SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. MYLENE S. YUMUL-ESPINA

For your information and guidance, quoted hereunder is the Resolution dated 19 February 2018 of the Special Third Division in Administrative Case No. 11238, entitled "Atty. Mylene S. Yumul-Espina v. Atty. Benedicto D. Tabaquero," to wit:

The Court NOTES complainant's Compliance and Manifestation dated November 22, 2017, relative to the Resolution dated September 4, 2017, submitting original copies of certifications from the lower courts of Pasay City, Parafiaque City, Las Piiias City and Muntinlupa City, all attesting that Atty. Mylene S. Yumul-Espina has not appeared in any of their court hearings and has not filed any legal pleading during the period of her suspension from the practice of law effective November 10, 2016 to May 6, 2017.

Considering the Report and Recommendation dated September 26, 2017 of the Office of the Bar Confidant (OBC) on complainant's Supplemental Manifestation (Re: Complainant's Service of Sanctions) and Motion to Lift Suspension from the Practice of Law, finding that the Certifications issued by the lower courts of Makati City and the local chapters of the Integrated Bar of the Philippines in Pasay-Paranaque-Las Pinas and Muntinlupa all attesting that Atty. Mylene S. Yumul- Espina did not engage in the practice of law nor appeared in court as counsel from November 10, 2016 to May 9, 2017 are substantial proof of compliance that she has fully served the six (6) months suspension from the practice of law, the Court, upon the recommendation of the OBC, resolves to:

(1) LIFT the order of suspension from the practice of law imposed on Atty. Mylene S. Yumul-Espina, as mandated in the Decision dated September 21, 2016, and ALLOW her to RESUME her practice of law; and

(2) REITERATE the September 4, 2017 Resolution and REQUIRE Atty. Yumul- Espina, upon full service of her disqualification from being commissioned as notary public on May 18, 2018, to SUBMIT similar certifications as required in the lifting of the order of her suspension before the order of disqualification is lifted.
