X----- ----------- ----- -- ----- --- --- ---- ------ --- --- -X RESOLUTION On December 1, 2022, the prosecution filed the Information dated February 24, 2020 with attached supporting documents, against herein accused for violation of Section 255 in relation to Sections 253 and 256 of Republic Act No. 8424. Finding that the Department of Justice (DOJ) Resolution dated February 24, 2020 which recommended/approved the filing of the Information to be a mere scanned copy, the Court ordered the prosecution to submit the original or certified true copy of the said DOJ Resolution within five (5) days from notice.1 Records show that, on February 7, 2023 , the prosecution received a copy of the Court's Resolution dated January 19, 2023 directing the former to submit the original or certified true copy of the DOJ Resolution dated 1 Resolution dated January 19, 2023, Docket.

CASE NO. 0 -964 Page 2 of2 February 24, 2020.2 Likewise, as per Records Verification Report dated February 21 , 2023, the prosecution failed to comply with the Court's Resolution. Based on the foregoing, the Court finds the supporting documents on record insufficient to establish a probable cause for the issuance of warrant of arrest.
