AN ACT CREATING THE BANGSAMORO NUTRITION COMMISSION IN THE

BANGSAMORO AUTONOMOUS REGION IN MUSLIM MINDANAO PROVIDINGFOR ITSMANDATE,POWERS,ANDFUNCTIONS APPROPRIATING FUNDS THEREFOR,AND FOR OTHER PURPOSES

Be it enacted by the Bangsamoro Transition Authority in Parliament assembled:

SECTION 1. Short Title. - This Act shall be known as the Bangsamoro Nutrition Commission Act of 2025."

SEC. 2.Declaration of Policy. -- The Bangsamoro Government recognizes the importance of nutritional improvement as the key component in human resource development. It is thus the policy of the

inhabitants of the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM). Bangsamoro Government to promote and protect access to adequate food and nutrition among all

Towards this end, the Bangsamoro Government shall establish a mechanism to facilitate

malnutrition in the region. This shall be carried out through policies, plans, monitoring, and programs that collaboration and cooperation among various agencies, sectors, and stakeholders in addressing hunger and are responsive to the needs of its constituents, especially vulnerable groups.

SEC.3. Creation of the Bangsamoro Nutrition Commission. - To carry out the declared policy there is hereby created a Bangsamoro Nutrition Commission, hereinafter referred to as the "Commission which shall be attached to the Office of the Chief Minister.

SEC. 4. Composition of the Commission. -- The Commission shall be composed of a Board of Commissioners headed by a Chairperson, with five (5) ex officio members, and the Executive Director of the Commission Secretariat as a member.

The Chairperson shall be a nutrition expert with wide experience and understanding of nutrition concerns in the BARMM.

The Chairperson, who shall be appointed by the Chief Minister, shall serve for a term of six (6) years, subject to reappointment.

The following shall serve as ex officio members of the Commission:

a) Minister of Health; bMinister of Basic,Higher and Technical Education cMinister of Agriculture,Fisheries, and Agrarian Reform d) Minister of the Interior and Local Government; and e)Minister of Social Services and Development.

SEC.5.Powers and Functions of the Commission. -The Commission shall be the policy-making and coordinating body in all matters related to food and nutrition, nutrition and health, and food security issues in the BARMM.To this end, it shall have the following powers and functions

a) Prescribe and promulgate regional food and nutrition, nutrition and health, and food security

policies and strategies;

b) Coordinate the planning, monitoring, and evaluation of the regional food and nutrition programs carried out by BARMM ministries, offices, and agencies, including the private sector

concerned with improving the nutrition of the people; As part of this function, the Commission

f) Lead the conduct of research on the state of food security and nutrition in the region

g) Ensure that all Local Nutrition Action Plans (LNAPs) of Local Government Units (LGUs) in the Bangsamoro Region are consistent with the BPAN;

h) Strengthen stakeholders' ownership of food and nutrition plans, programs, and strategies by

ensuring meaningful and sustained participation at every stage - from planning and implementation to monitoring and evaluation;

i) To call on any ministry, office, agency, and other instrumentalities of the Bangsamoro Government for assistance in the form of personnel, facilities, and resources as the need arises;

j)Create Technical Working Committees as the need arises;

k) Accept donations, contributions, grants, bequests, or gifts, in cash or in kind, from domestic or

foreign sources for purposes relevant to its functions, subject to the appropriate policies and

guidelines set by the Bangsamoro Government and the rules promulgated by the Intergovernmental Fiscal Policy Board; and

lExercise such powers and perform such functions as may be necessary in carrying out the objectives and provisions of this Act, including but not limited to the intent of existing national

laws in support of health, nutrition, and food security.

SEC. 6. Organizational Structure. - The Commission shall consist of the Office of the Chairperson, the Office of the Commission Secretariat, and such other appropriate divisions or units as may be necessary, including an Administrative and Finance Division.

SEC.14. Appropriations. -The amount of not less than Fifteen Million Pesos (PHP15,000,000.00) shall be initially appropriated to implement the provisions of this Act. The succeeding budget of the Commission shall be included in the annual General Appropriations Act of the Bangsamoro Government.

SEC. 15. Implementing Rules and Regulations. - The MOH shall formulate and issue the necessary rules and regulations for the implementation of this Act within ninety (90) days from its effectivity.

SEC. 18.Effectivity. -- This Act shall take effect fifteen (15) days after its publication in the Bangsamoro Gazette or in a newspaper of regional circulation within the BARMM.
