Alexis Joseph R. Noble and counsel for respondent, Atty. Victor Eleazar S. J. Santos, appeared for the Pre-trial Conference. Petitioner' s counsel manifested that he filed a Motion to Reset Pre- trial Conference on September 18, 2015 on the ground that he needed to examine the BIR Record first before he could prepare the Judicial Affidavits of his witnesses. Finding the ground without merit and considering petitioner's failure to file the required Pre-trial Brief despite notice, this case was dismissed pursuant to Section 6, Rule 18 of the Rules of Court.
