X-------- -- ---- -------------------- ---- ---- - ----- -X RESOLUTION On October 01, 2013, the Court En Bane has granted the "Motion for Extension of Time to File Petition for Review" filed by petitioner People of the Philippines on September 26, 2013 , wherein petitioner was given a final and non-extendible period of fifteen (15) days or until October 11, 2013, within which to file the Petition for Review. However, it appears from the Report dated December 03, 2013 of the Judicial Records Division addressed to Atty. Elvessa P. Apolinario, Executive Clerk of Court IV, of the Court En Bane, that as of such date and per record of this Court, counsel for petitioner has failed to file a Petition for Review in the above-entitled case. WHEREFORE, in view of the foregoing, the Court En Bane considers petitioner to have ABANDONED its intention to file Petition for Review. Consequently, this case IS deemed CLOSED and TERMINATED.
