AGARANG KALINGA AT SAKLOLO PARA SA MGA OFW NA GUIDELINES ON THE IMPLEMENTATION OF THE

NANGANGAILANGAN(AKSYON) FUND

All OFWs,whether land-based or sea-based, documented or undocumented,regardless of immigration status, who need medical, financial, psycho-social, legal, rescue repatriation assistance, or any other kind of analogous interventions, including the transport of human remains are entitled to avail of the benefits or assistance provided for by the AKSYON Fund. The next kin of OFWs in distress or families left behind as defined herein can also avail of humanitarian assistance through the AKSYON Fund

DEFINITION OF TERMS ARTICLE I

For the purpose of this Guidelines, the following terms are hereby defined as -

AKSYON Fund -refers to the Agarang Kalinga at Saklolo para sa mga OFWs na Nangangailangan (AKSYON) Fund or the fund created under Section 14 of R.A. No. 11641 to provide legal, medical, financial, and other forms of assistance to Overseas Filipino Workers, including repatriation, shipment of remains,evacuation,rescue and any other analogous intervention to protect the rights and promote the welfare of Filipino migrant workers.

of assistance for OFWs in distress from the OFW himself or herself, families

community leaders and/or organizations, among others. left behind,other government agencies,non-government organizations,media and other social platforms,OFW advocates,civil society organizationsFilipino

FUND ADMINISTRATION ARTICLE II

The Fund shall be administered by the Undersecretary for Foreign Employment and Welfare Services pursuant to Section 9b(4) of RA 11641. As Fund Administrator, the Undersecretary shall authorize disbursements from the Fund upon recommendation of

FORMS AND SCOPE OFASSISTANCE ARTICLE IV

Section 1. Forms of Assistance. The Fund shall provide legal and other forms of assistance to OFWs as mandated by Section 14,RA 11641. These forms of assistance include:

a. Legal assistance to any OFW in distress, who is a party to a civil, criminal, labor or other dispute at the host country and who is unable to

engage the services of a private counsel in a country where there is no system of legal aid or public defenders nor access to counsel de officio or any lawyer provided by the host government.

and shall determine the authorized amount of legal fees,scope of services and other pertinent matters relative to the legal representation for and in behalf of the OFWs in distress. The MWO shall be authorized to retain the services of a lawyer or law firm

Legal assistance may be in the form of referral or networking with lawyers, non-government organizations,and other service centers. The MWO is authorized to enter into partnership agreements in the provision of legal assistance.

Legal assistance shall include but shall not be limited to the following cases

1. Those arising from an employer-employee dispute, immigration case, police case, or other analogous legal proceeding including, among others,an action for tort or civil damages, immigration detention, other

1.The MW Officer handling the case of an OFW in distress may recommend the provision of legal assistance to the Migrant Worker Officer. In applicable cases, the MW Staff Officer shall observe the guidelines on conciliation-mediation prior

2. The period for evaluation by the MW Staff Officer shall be within three (3) days from receipt of the request for assistance(RFA),unless the case of an OFW in

distress reguires extreme urgent intervention.

Section 3.Medical Assistance and Repatriation of Physically or Mentally Ill OFWs

1.The MW Staff Officer or Welfare Officer receives the request for medical

assistance or repatriation of the physically or mentally ill OFW. The request may come from the OFW, NOK or other referring client, either in person through email or other forms of communication.

2. The MW Staff Officer or Welfare Officer shall evaluate the request and report

his or her recommendation to the Migrant Worker Officer within three(3) days

to the requesting party. from receipt of the RFA.The action taken shall be communicated accordingly

Section 5. Transport of shipment of human remains of the OFW in distress

1. The MW Staff Officer or Welfare Officer receives the request for repatriation of

the remains of the OFW in distress from the NOK or a referring party,either in person, through email or other forms of communication.

2. The MW Staff Officer or Welfare Officer shall evaluate the request and report

his or her recommendation to the Migrant Worker Officer within three (3) days

to the requesting party. from receipt of the RFA. The action taken shall be communicated accordingly

MISCELLANEOUS PROVISIONS ARTICLE IX

Section 9.Repealing Clause.All other laws, decrees,orders, rules and regulations or parts thereof inconsistent with this Guidelines are hereby repealed or modified accordingly.

Section 10.Separability Clause.Should any provision herein be subsequently declared unconstitutional, the same shall not affect the validity or legality of the other provisions.
