Petitioner filed on July lz, l960 a Motion

seoking the dismissal of its petition for reviow,

filed on July 7, l956,on the ground that respondent

cancelled the dfsputed real eatate dealer's fixed

tax assessed against the petitioner, as evidenced

by respondent's letter to petitioner's counsel dated

July 7. l960 which was quoted verbatin in petitioner's

"Motion". Respondent interposed no objection to the

diemissal of the petition for review herein when the

case was callod for hearing on August 6, l960.
