WILLARD, J.:

PARTNERSHIP; UNLAWFUL EXCLUSION OF PARTNER; LOSS OF GOODS.—From the Court of First Instance of Sorsogon. Ross, J.

The evidence produced in the court below shows that the defendant, the municipal president of Gubat, caused the arrest of the plaintiff and took possession of his store, refusing to deliver it to the plaintiff's partner when requested, and denied him admission thereto. The store was left unguarded and merchandise and money was taken therefrom to the damage of the plaintiff in the amount of P612.20. The refusal of the defendant to admit the partner was an unlawful act, and defendant held responsible for the consequences. Judgment for plaintiff affirmed.
