Petitioner is hereby ORDERED to submit within five (5) days from receipt of this Resolution the required Authority to Cancel Assessment (ATCA) in addition to the Termination Letter attached to the above-mentioned Manifestation and Motion. The Motion of the petitioner praying that an order be issued declaring the instant case closed and terminated, is hereby HELD IN ABEYANCE pending the submission of the said Authority to Cancel Assessment. SO ORDERED. ~

CTA EB Case No . 353 (6988) RESOLUTION On October 12, 2009, respondent, in compliance with the said Resolution, filed a Compliance stating, among others, that it is submitting to the Court a certified true copy of the Authority to Cancel Assessment dated September 9, 2009. WHEREFORE, premises considered, in view of the submission by the petitioner of the required Authority to Cancel Assessment dated September 9, 2009 (certified true copy), in addition to the Termination Letter dated June 1, 2009 which was earlier submitted to this Court and pursuant to the provision under the last paragraph of Sec. 5 of Revenue Regulations No. 15-2007, the Petition for Review in the above-captioned case is hereby considered CLOSED and TERMINATED.
