Respondent failed to file her comment despite due notice. In its "Manifestation and Motion", petitioner states that it already paid the assessed deficiency VAT, expanded withholding tax and final Walding tax

C.T.A. CASE NO. 8298 2 RESOLUTION of VAT for taxable year 2006, and prays that the instant petition be considered withdrawn. In support of its motion, petitioner filed its Compliances dated February 22,2012 and May 18,2012, submitting the following documents: 1) a photocopy of respondent's letter dated January 16, 2012; 2) BIR Payment Form (0605) for VAT; 3) BIR Payment Form (0605) printed from Efps for VAT; 4) Transaction Acknowledgment for VAT; 5) BIR Payment Fonn (0605) for EWT; 6) BIR Payment Form (0605) printed from eFPS for EWT; 7) Transaction Acknowledgment for WE; 8) BIR Payment Fonn (0605) for FWT of VAT; 9) BIR Payment Form (0605) printed from eFPS for FWT of VAT; 10) Transaction Acknowledgment for WG; and 11) Petitioner's Letter Request for Termination/Closure of Case, dated January 2, 2012. Both "Compliances dated February 22, 2012 and May 18, 2012" are hereby NOTED. Considering that petitioner paid the assessed deficiency VAT, EWT, and FWT on VAT, and without any objection from respondent CIR, this Court finds petitioner's Motion to Withdraw to be well-taken.
