In its Motion , petitioner avers that it applied for tax amnesty under R.A. 9480; filed the required documents; paid the applicable amnesty tax; and is not excepted or disqualified to avail of the tax amnesty as provided in Sec. 8

Hence, it prays that the first Amended Petition be considered withdrawn or a judgment be rendered declaring the extinguishment of its tax liability. Attached to the motion are certified true copies of the following documents: (1) Notice of Availment of Tax Amnesty; (2) Tax Amnesty Return ; (3) Tax Amnesty Payment Form ; (4) RCBC 's Deposit Slip; and (5) Certificate of Qualification issued by the Revenue District Office No. 019 of Subic Bay Freeport Zone. As petitioner already presented a certified true photocopy of the original Certification of Qualification (For the Tax Amnesty) dated February 5, 2008, this Court finds petitioner's motion to be well-taken . Hence, the same is hereby GRANTED. WHEREFORE, premises considered , the Petition for Review in the above-captioned case is deemed WITHDRAWN .
