Clarissa V. Babaran, appeared. Counsel for petitioner failed to appear despite due notice. Records show that the Order of this Court granting petitioner's Motion for Postponement of the Pre-Trial and the resetting of the Pre- Trial to January 19, 2017 was received by petitioner's counsel on December 5, 2016 but petitioner's counsel failed to appear at today's pre-trial. Also, no pre-trial brief for petitioner was filed. Consequently, counsel for respondent moves that the case be dismissed. Finding merit in the motion, the same is hereby GRANTED. WHEREFORE, the case in caption is hereby DISMISSED for failure of petitioner to appear at today's pre-trial and for its failure to file its pre-trial brief (Sections 5 & 6, Rule 18 of the 1997 Rules of Civil Procedure, as amended).
