RESOLUTION

The petitioner hes appealed frcm the deci- aion of the respondent holding the fermer liable for

tho payment of tho sum of 10,478.35, as fixad and

nercentage taxac, plus surcharge. aa an independant

contractor under Sections ls2 and l9l of the Nation-

al Internal Bevenue Code. Pefor trial, petiticner

sought a reconsideration of respondent's deciaion.

Upon further consideration of the case, res-

pondent rendered a decision withdrawing and cancei-

ltng the aforesaid cssesament. Accordingly. peti-

tioner has filed a motion for mithdrawel of its pe-

tition for reviow.

The motion for withdrawal was ort for heaxing

on August 13, 1960. on which date meithex party ap-

neared.

WEReFOR, the moticn for withdrawal of the

herein petition fcr review it hereby granted.
