Tho petitioner, Wack Wack Golf a Country Club,

Ine., filed on April 28, 196l, a motion to aiamiss

tho above-antitlod case on the ground that the assess-

ment, which is the aubjeet-matter of the sam, has

been cancelled and withdrawn by the Commissioner of

Internal Rovenue in his letter dated February 1+, l961

(see P. 46, ctA rac.).

WHEREFORE, finding the motion woll taken and

there being no objoetion interposed by counsel for

the rospondant, ths same is hereby granted. Lot the

petition for roview ia the above-ontitied caso be dis-

missed; without pronouncoment as to costs.
