REPUBLIC OF THE PHILIPPINES DEPARTMENT OF FINANCE BUREAU OF INTERNAL REVENUE Quezon City March 09, 2007 REVENUE MEMORANDUM CIRCULAR NO. 16-2007 SUBJECT : Publishing The Full Text Of OCA Circular No. 05-2007 Issued By The Office Of The Court Administrator Of The Supreme Court To : All Revenue Officials and Personnel x ------------------------------------------------------------------------------------------------------- x For the information and guidance of all internal revenue officials and personnel, quoted hereunder is the full text of OCA Circular No. 05-2007 which was issued upon the request of the undersigned, by the Office of the Court Administrator of the Supreme Court, directing judges and clerks of court of the Regional Trial Courts to notify the Bureau of Internal Revenue through the Commissioner whenever petitions are filed in court involving cases of rehabilitation, insolvency, corporate dissolutions by judicial means and judicial settlements of estates of deceased persons, to enable the Bureau take the necessary actions to protect the interest of the government which has the first preference in the liquidations thereon: "OCA CIRCULAR NO. 05-2007 TO: ALL JUDGES AND CLERKS OF COURT OF THE REGIONAL TRIAL COURTS SUBJECT: ISSUANCE OF NOTICE TO THE BUREAU OF INTERNAL REVENUE It has come to the attention of the Court that in all cases of rehabilitation, insolvency, corporate dissolutions by judicial means and judicial settlements of estates of deceased persons, the Bureau of Internal Revenue is not notified of filing such petitions, thereby the interest of the government who has the first preference in the liquidations thereon are prejudiced. Henceforth, you are hereby directed to notify the Commissioner of the Bureau of Internal Revenue

whenever a petition for the abovementioned case is filed in your respective courts. Strict compliance herewith is hereby enjoined. January 24, 2007 (SGD.) CHRISTOPHER O. LOCK Court Administrator" Henceforth, whenever such notices from the courts are received by the Bureau of Internal Revenue and the same are accordingly endorsed to your respective offices, you are hereby enjoined to immediately take such actions as may be necessary to ensure that the taxes due from the companies or estates of deceased persons involved in said cases, as the case may be, are claimed in such proceedings by the Bureau, asserting the right of first preference of the government in such liquidations, with the end in view of protecting the interest of the government.
