Records show that petitioner had consecutively failed to present its evidence despite the numerous settings for its initial presentation of evidence, to wit: May 25, 2009, June 15, 2009, July 15, 2009, and in today's hearing, October 14, 2009. WHEREFORE, for failure of petitioner to prosecute its action and upon motion of counsel for respondent, the Petition for Review in this case is hereby DISMISSED pursuant to Section 3, Rule 17 of the 1997 Rules of Civil Procedure and the above-captioned case is deemed CLOSED and TERMINATED.
