PromAW~ '1997 X- - - - - - - - - - - - - - ---------~ RESOLUTION Acting on the "Joint Submission of Documents and Motion" filed by both the petitioner and the respondent on August 18, 1997, 1n relation to the "Joint Manifestation" filed by the same parties on August 4, 1997, this Court, taking note also of the favorable comment of the Office of the Solicitor General, hereby allows the redemption of one (1) unit Helicopter Aerospatiale 350 B, Model 1990, Serial No. 3229, by the petitioner under the terms and conditions as recommended by the Deputy Commissioner of Customs and approved by the Under Secretary of Finance , it appearing that the same is done pursuant to Section 2307 of the Tariff and Customs Code.

RESOLUTION CTA CASE NO. 5404 -2- ACCORDINGLY, let the instant Petition for Review be considered withdrawn and this case be deemed closed and terminated. The Surety Bond posted by the petitioner, namely Prudential Guarantee and Assurance Inc., PGA Bond No. H0 - 39380- 96 for the temporary release of the subject helicopter, is hereby ordered cancelled.
