REPUBLIC OF THE PHILIPPIN ES COURT OF TAX APPEALS QUEZON CITY SECOND DIVISION MUNICIPALITY OF ITOGON, CTA AC No. 238 BENGUET, and ANGELA C. (RTC Civil Case No. 10-CV-2608) CARINO, Members: Petitioners, CASTANEDA, JR., Chairperson -versus- and BACORRO-VILLENA, JJ. NATIONAL POWER CORPORATION (NPC), & POWER SECTOR ASSETS AND LIABILITIES MANAGEMENT Promulgated: CORPORATION (PSALM), OCT 0 6 2021 Respondents. }:1-1 ~ "' x-------------------------------------------------------------------------1--------x RESOLUTION CASTAN EDA, JR., J.: Records show that on March 9, 2021, petitioners filed via registered mail only one (1) copy of their Motion for Reconsideration which was received by this Court on May 19, 2021. In a Minute Resolution dated May 20, 2021, this Court noted the insufficiency of the copies of the said Motion for Reconsideration. Accordingly, pursuant to A.M. No. 11-9-4-SC in relation to CTA En Bane Resolution No. 5-2013 dated May 28, 2013, this Court directed petitioners to submit additional three (3) copies thereof within a period of ten (10) days from notice with a stern warning that failure to submitA..- cooor 338
RESOLUTION CTA AC No. 238 Municipa lity of Itogon, Benguet, et. al. v. National Power Corporation et. al. such additional copies within the prescribed period shall constrain this Court to consider the said Motion as deemed not filed. Petitioners failed to comply with the said Minute Resolution despite due notice per Records Verification dated July 12, 2021. CTA En Bane Resolution No. 4-2012 dated September 3, 2012 explicitly provides that "failure to submit the lacking documents within the period given shall constrain the Court to consider the pleading/submission as deemed not filed." Given that only a single copy of the Motion for Reconsideration was filed and petitioners utterly failed to submit the lacking copies as directed, petitioners' Motion for Reconsideration is DEEMED NOT FILED and is thus considered a mere scrap of paper.
