Lorna SB. Cruz entered her special appearance as counsel for respondent. Counsel for petitioner, Atty. Amelita Antonio Velasco , failed to appear despite notice . Record shows that upon motion of counsel for petitioner, the initial presentation of evidence for petitioner had already been reset four (4) consecutive times, as follows : July 15, 2013, August 12, 2013, October 7, 2013, and November 4, 2013. The last resetting was granted with warning to petitioner that it was for the last time. WHEREFORE, considering the failure of counsel for petitioner to appear and considering further that the initial presentation of evidence for petitioner had already been reset for four (4) consecutive times, the above-captioned case was DISMISSED for failure to prosecute .
