However, petitioner manifested that it intends to continue litigating CTA Case No. 11055. There being no objection on the part of respondent Commissioner of Internal Revenue, the Court resolves to grant p etitioner's Motion to Withdraw Petition for Review in CTA Case No. 11135 and to continue the proceedings in CTA Case No. 11055. WHEREFORE, the Petition for Review docketed as CTA Case No. 111 35 is WITHDRAWN . Accordingly, CTA Case No. 11135 is deemed CLOSED and TERMINATED.
