COMMISSIONER OF Promulgated: INTERNAL REVENUE, F~q~(bllfl/ Respondent. ){- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -){ RESOLUTION On January 22, 2024, petitioner filed a Motion to Withdraw Petition for Review (Re: CTA Case No. 11135), praying that the instant Petition for Review, relative to CTA Case No. 111 35, be withdrawn on the ground that its administrative claim for refund in the total amount of Php 1,488,454,886.83, arising from the erroneous payment of eJCcise taJCes, which includes the subject of CTA Case No. 11135, had been granted by the Bureau of Internal Revenue (BIR). However, petitioner manifested that it intends to continue litigating CTA Case No. 11055. There being no objection on the part of respondent Commissioner of Internal Revenue, the Court resolves to grant p etitioner's Motion to Withdraw Petition for Review in CTA Case No. 11135 and to continue the proceedings in CTA Case No. 11055. WHEREFORE, the Petition for Review docketed as CTA Case No. 111 35 is WITHDRAWN . Accordingly, CTA Case No. 11135 is deemed CLOSED and TERMINATED.
