DelaRosa IV, as lead counsel, together with Associate Solicitor Lanz Aidan L. Olives, appeared for respondent Commissioner of Customs. There was no appearance for petitioner. The Court noted the Motion for Cancellation and Resetting dated March 22, 2023, personally filed by petitioner and received by the Court on even date. Upon motion of counsel for respondent and upon finding petitioner's Motion for Cancellation and Resetting insufficient to justify the non-appearance and failure to file its Pre-Trial Brief, the Court DENIED the Motion for Cancellation and Resetting. Therefore, pursuant to Section 5, Rule 18 of the Rules of Court, the Petition for Review was DISMISSED for failure of petitioner to appear in the Pre-Trial Conference without valid cause. SO ORDERED.
