Ramon B. Lorenzo, appeared and manifested the he is submitting this case for decision without presenting any evidence, and moved for thirty (30) days to file respondent's memorandum, which the Court granted. Record shows, however, that on February 5, 2009 petitioner filed a "Motion to Withdraw Petition" praying for the withdrawal of its Petition for Review on the ground that petitioner has come to the conclusion that under the present circumstances, the pursuit of this petition with this Court will not be to the best interest of the company. Finding the motion to be well-taken, the same is hereby granted. WHEREFORE, premises considered, the present Petition for Review is deemed WITHDRAWN, and the case is deemed CLOSED and TERMINATED.
