Jose Paolo I. Brillantes, and counsel for respondent, Atty. Roel A. Zafra, appeared. Counsel for petitioner manifested that he filed a Motion to Reset Pre- trial Conference on January 23, 2014. The Court stated that said Motion was denied in the Resolution dated February 14, 2014. Thereafter, considering that petitiomer has not filed a Pre-trial Brief, counsel for respondent moved for the dismissal of the case. As prayed for, this case was DISMISSED without prejudice. The "Compliance" dated January 22, 2014 filed by the counsel for the respondent is hereby NOTED. SO ORDERED.
