SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. JOHNNY P. LANDERO
For your information and guidance, quoted hereunder is the Resolution dated 13 July 2016 of the Second Division in Administrative Case No. 5116, entitled "Davao Import Distributors, Inc. [DIMDI] v. Atty. Johnny P. Landero," to wit:
The Court resolves to:
1. NOTE and DEEM AS SERVED by substituted service pursuant to Section 8, Rule 13 of the 1997 Rules of Civil Procedure, as amended, the returned and unserved copies of the Resolutions dated 17 August 2015 and 24 February 2016 sent to Atty. Pedro S. Castillo, counsel for complainant at Mezzanine Floor, Quimpo Building, Rizal Street, 8000 Davao City with notation, "Return To Sender, Moved," and "RTS, Moved," respectively;
2. NOTE the motion to lift suspension order dated 3 February 2016 of respondent Atty. Johnny P. Landero, submitting certification from the Regional Trial Courts and Municipal Trial Courts, that he desisted from appearing as counsel during the effectivity of his six (6) months suspension from 20 May 2015 to 20 November 2015, and praying that this Court lift his suspension; and
3. NOTE the manifestation with submission of a corrected certification from the local Integrated Bar of The Philippines dated 13 April 2016 of respondent Atty. Landero, stating that he already complied with the lifting of his suspension from the practice of law except for the erroneous certification marked as Annex "C" and "D" issued by the local Integrated Bar of the Philippines, and submitting the correct certification, with prayer for the lifting of his suspension.
Acting on respondent Atty. Landero's motion to lift his suspension order pursuant to the Resolution dated 13 April 2016 which suspended respondent from the practice of law for six (6) months, and considering that respondent has submitted the required certifications from different courts of the RTC, General Santos City, Cotabato, and certification of the IBP South Cotabato and General Santos City, both affirming that respondent has ceased and desisted from the practice of law and has not appeared in Court as counsel from 20 May 2015 to 20 November 2015, the Court further resolves to LIFT the order of suspension from the practice of law for six (6) months imposed on respondent Atty. Johnny P. Landero in the Resolution dated 13 April 2016 and ALLOW him to RESUME his practice of law.
The Court NOTES the Report and Recommendation dated 2 May 2016 of the Office of the Bar Confidant.
