REORGANIZING THE BANGSAMORO HALAL BOARD (BHB) AND INCLUDING THE BANGSAMORO PLANNING AND DEVELOPMENT

AUTHORITY (BPDA) IN ITS COMPOSITION

WHEREAS, Section 37, Chapter 7, Title XIV of Bangsamoro Autonomy Act (BAA) No. 13, otherwise known as the "Bangsamoro Administrative Code", created the BHB as the policy-making body of the Bangsamoro Government on Halal Industry Development and shall set the overall direction for the implementation of Bangsamoro Halal Industry Development and Promotion Program. It shall be attached to the Ministry of Trade, Investments and Tourism (MTIT);

WHEREAS, pursuant to Section 35, Chapter 7, Title XIV of BAA No. 13, the BHB shall be composed of the MTIT as Chairperson; the Ministry of Agriculture, Fisheries, and Agrarian Reform as Vice-Chairperson; the Ministry of Science and Technology; the Ministry of Health; the Ministry of Labor and Employment; the Ministry of Transportation and Communications; the Mufti of the Bangsamoro Darul-Ifta'; a representative from the Mindanao State University System; and Two (2) Bangsamoro professionals from the academe, law, industry, or food science who have experience in halal industry development, to be appointed by the Chief Minister from at least four (4) nominees recommended by the Bangsamoro civil society organizations;

WHEREAS, based on Section 39, Chapter 3, Title III of BAA No. 13, the BPDA shall serve as the planning, coordinating, and monitoring agency for all development plans, policies, programs and projects of the Bangsamoro Government;

WHEREAS, the BHB passed Resolution No. 05 dated March 10, 2023, entitled, "Resolution-for the Inclusion of Bangsamoro Planning Development Authority in the Composition of Bangsamoro Halal Board (BHB)," recognizing the expertise of BPDA in developing socio-economic policies and plans of the Bangsamoro Government and proposing its inclusion as additional member of the BHB;

WHEREAS, there is a need to include BPDA as a member of the BHB in recognition of the former's indispensable role in the development planning, programming, monitoring and evaluation, and coordination of all development initiatives in the region, which are vital in attaining the objectives of the BHB in the promotion, development, and sustainability of the region's Halal industry;

WHEREAS, in the exercise of executive authority, the Chief Minister shall have continuing authority to reorganize executive offices, as provided under Section 68, Chapter 4, Title I, Book IV of BAA No. 13;

WHEREAS, Sec. 1, Chapter 1, Title I, Book IV of BAA No. 13 grants the Chief Minister the power of control and supervision over all ministries, agencies, offices, bureaus, commissions, boards, and instrumentalities of the Bangsamoro Government. He shall ensure that laws are faithfully executed;

WHEREAS, the purpose of this Order is merely to include the BPDA in t. composition of the BHB without any modification in the powers and functions granted to the latter under BAA No. 13;

NOW, THEREFORE, I, AHOD B. EBRAHIM, Chief Minister of the Bangsamoro Autonomous Region in Muslim Mindanao, by virtue of the powers vested in me by law, do hereby order the inclusion of BPDA to the existing composition of the BHB:

Section 1. Composition. The BHB shall be composed of the Minister of Trade, Investments and Tourism as Chairperson; Minister of Agriculture, Fisheries and Agrarian Reform as Vice-Chairperson; Minister of Science and Technology; Minister of Health; Minister of Labor and Employment; Minister of Transportation and Communications; Bangsamoro Director General of the Bangsamoro Planning and Development Authority; Mufti of the Bangsamoro Darul-Ifta'; Representative from the Mindanao State University System as members; and two (2) Bangsamoro professionals from the academe, law, industry, or food science who have experience in halal industry development;

Section 2. Separability. If any provision or portion of this Order is declared invalid or unconstitutional, the remaining provisions not affected thereby shall continue to be in full force and effect.

Section 3. Repeal. All orders, rules and regulations, other issuances, or parts thereof, which are contrary to or inconsistent with the provisions of this Order are hereby repealed or modified accordingly.

Section 4. Effectivity. This Order shall take effect immediately.
