SUBJECT : LIFTING OF SUSPENSION FROM THE PRACTICE OF LAW OF ATTY. DANIEL RAFAEL B. PENUELA

For your information and guidance, quoted hereunder is the Resolution dated 12 August 2015 of the Third Division in Administrative Case No. 7904, entitled "Rhodora B. Yutuc v. Atty. Daniel Rafael B. Penuela," to wit:

Respondent's Ex-Parte Motion to Lift September 22, 2008 Order of Suspension dated June 9, 2015 is NOTED.

This refers to the Report and Recommendation dated June 19, 2015 of the Office of the Bar Confidant (OBC) on respondent's ex-parte motion to lift order of suspension, finding that respondent has fully served his one (1) year suspension from the practice of law from October 29, 2008 to October 29, 2009, submitted the required certifications from the courts and the Integrated Bar of the Philippines that he has not practiced law and not appeared in any court in Bacolod City and Negros Occidental during the suspension period and has reimbursed the full amount of P25,000.00 plus 6% interest to the complainant as directed in the Resolution dated September 22, 2008, the Court, upon the recommendation of the OBC, resolves to:

(1) LIFT the one year suspension of Atty. Daniel Rafael B, Penuela and ALLOW him to RESUME his law practice; and

(2) INFORM respondent that the request for clearance can only .be issued upon lifting the order of suspension by the Court and after payment of the necessary fees to the Supreme Court Cashier.

The said report and recommendation of the OBC is NOTED.
