OPERATIONALIZING THE BANGSAMORO GAZETTE, PROVIDING GUIDELINES
THEREFOR AND OTHER PURPOSES
WHEREAS, under Section 24, Article II of the 1987 Constitution, it is declared policy of the State to recognize the vital role of communications and information in nation-building:
WHEREAS, under Section 7, Article III of the above-mentioned law guarantees the right of the people to information on matters of public concern shall be recognized. Access to official records, and to documents, and papers pertaining to official acts, transactions, or decisions, as well as to government research data used as basis for policy development, shall be afforded the citizen, subject to such limitations as may be provided by law;
WHEREAS, Section 14, Chapter 3, Book 1 of Bangsamoro Autonomy Act (BAA) No. 13 otherwise known as the "Bangsamoro Administrative Code", provides that the Bangsamoro Gazette shall be the official gazette of the Bangsamoro Government and shall publish all legislative acts and resolutions of a public nature, all executive and administrative issuances of general application, decisions or abstracts of decisions of the Shari'ah Courts of sufficient importance to be published, documents or classes of documents as may be required to be published by law and such documents or classes of documents of general application;
WHEREAS, the same law further provides that the Bangsamoro Gazette shall be published by the Bangsamoro Information Office;
WHEREAS, Section 12 of the same law requires the publication of executive issuances in the Bangsamoro Gazette or newspaper of general circulation to take effect;
WHEREAS, the Bangsamoro Government recognizes to the need to raise public access to information, prevailing regional laws, and pertinent issuances;
NOW, THEREFORE, I, AHOD B. EBRAHIM, Chief Minister of the Bangsamoro Autonomous Region in Muslim Mindanao, by virtue of the powers vested in me by law, do hereby order:
Section 1. Bangsamoro Gazette. Pursuant to the provisions of Bangsamoro Autonomy Act No. 13, otherwise known as the "Bangsamoro Administrative Code", The Bangsamoro Gazette shall be the official gazette of the Bangsamoro Government which will serve as the official publication of the Bangsamoro Government under the Bangsamoro Information Office.
Section 2. Contents. The Bangsamoro Gazette shall publish the following official documents from the Bangsamoro Government:
a. Laws passed by the Bangsamoro Parliament; b. Resolutions of public nature passed by the Bangsamoro Parliament; c. Executive and administrative issuances of general application; d.Decisions of the Shari'ah Courts of sufficient importance; e. Documents or classes of documents as may be required to be published by law; and f. Such documents or classes of documents of general application.
Section 3. Editing. The Bangsamoro Information Office shall be responsible for the editorial functions over the Gazette, and the creation and maintenance of its official online accounts in coordination with the Office of the Chief Minister - Information and Communications Office (OCM-ICO) and the Bangsamoro Information and Communications Technology (BICTO).
Section 4. Publication. The Bangsamoro Gazette shall be made available both in print and online.
a. Print version - The print version of the Gazette shall be published quarterly by the Bangsamoro Information Office. It shall contain the documents enumerated in Section
b. Online Version -- A website shall be maintained and administered by the Bangsamoro 2 of this Order.
Information Office in coordination with the Office of the Chief Minister - Information and Communications Office (OCM-ICO) and the Bangsamoro Information and Communications Technology (BICTO). Publication shall be posted as often as possible. The website shall contain the documents enumerated in Section 2 of this Order, an archive of all laws and resolutions passed by the Regional Legislative Assembly of the defunct Autonomous Region in Muslim Mindanao, and any other official document from the Bangsamoro Government or the defunct Autonomous Region in Muslim Mindanao of general applicability and legal effect.
Section 5. Archiving. The Bangsamoro Library and Archives shall serve as the official custodian and repository of printed copies of the Bangsamoro Gazette.
The Bangsamoro Library and Archives shall also coordinate with the Bangsamoro Information Office, Bangsamoro Parliament, and the OCM-ICO for publication of the archived documents in the online version of the Gazette.
Section 6. Subscription. All ministries, offices, and agencies of the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM), including but not limited to other government instrumentalities and government-owned and controlled corporations, state universities and colleges, and local government units inside the jurisdiction of BARMM, shall subscribe to the print version of the Bangsamoro Gazette and pay for the same out of their respective funds. The print version of the Bangsamoro Gazette shall be filed and properly kept with the public records of the ministry, offices, agency or instrumentality, province, city, or municipality concerned for reference.
The online version shall be accessible to the public.
Section 7. Rates and Collection of Fees. The subscription rate shall be P4,056.00 for the quarterly printed editions of the Bangsamoro Gazette payable in advance by Cashier's Check, Manager's Check, Postal Money Order (PMO) or cash. All money orders and checks should be addressed to the OCM-BARMM. The fee shall be utilized for the operational expenses of the Gazette.
The Office of the Chief Minister, through the Bangsamoro Information Office, shall be responsible for the collection of these fees.
The Bangsamoro Information Office may adjust the subscription rate with concurrence of the cabinet and the approval of the Chief Minister, provided that, any adjustment in subscription rate shall be announced in the online and print versions of the Bangsamoro Gazette two weeks before implementation.
Section 8. Submission of Documents. All ministries, offices and agencies of the Bangsamoro Autonomous Region in Muslim Mindanao, including but not limited to other government instrumentalities and government-owned and controlled corporations, state universities and colleges, and local government units inside the jurisdiction of BARMM shall submit and coordinate with the Bangsamoro Information Office for efficient and speedy publication of certified true copies of all documents, enumerated in Section 2 of this Order, in their custody and any other relevant document which shall be published in the Bangsamoro Gazette.
Section 9. Effectivity of Laws. Executive issuances and legislations of the Bangsamoro Government shall take effect fifteen (15) days following the completion of their publication in the Bangsamoro Gazette or in a newspaper of regional circulation unless a specific period of effectivity has been prescribed therewith.
For administrative issuances of general application that require publication in a newspaper of regional circulation for effectivity, the responsibility shall fall upon the ministry, agency, or office.
For purposes of determining the effectivity of laws and executive issuances, the online publication in the official website of the Bangsamoro Gazette shall be considered an official publication, provided that there shall be a timestamp in the said document.
In cases where there is a conflict between the language of the law published online and in print, the latter's version shall prevail.
Further, the publication of any legislative acts and resolutions of public nature, any administrative or executive issuances of general application, or other official documents in the electronic and/or print versions of the Bangsamoro Gazette shall be deemed prima facie evidence of its authority.
Section 10. Separability Clause. If any section or part of this Order is held unconstitutional or invalid, the provisions not otherwise affected shall remain in full force or effect
Section 11. Repealing Clause. All orders, memoranda or similar instructions inconsistent therewith are hereby revoked, canceled, or modified accordingly.
Section 12. Effectivity Clause. This Order shall take effect immediately upon
approval.
