APPROPRIATING FROM THE TWENTY-PERCENT (20%) ALLOCATION FOR EQUIPMENT AND FACUJTIES OF THE JUDICIARY DEVELOPMENT FUKD THE SUM OF P80 MILLION FOR THE CONSTRUCTION OF THE COURT OF APPEALS BUILDINGS IN CEBU CITY AND CAGAYAN DE ORO CITY

WHEREAS, pursuant to Republic Act No. 8246,. sk mew Divisions of the Court of Appeals, the Eighteenth to the thirty-third, were established, wth the first three stationed in Cebu City and the otihieir three, in Cagayan de Oro City;

WHEREAS, on 15 October 2004, the Cebu City station for Eighteenth. Nineteenth and Twentieth Division was formally inaugurated; while the Cagayan de Oro station for the Twenty-First, Twenty-Second, Twenty-Third Divisions will be inaugurated onn 7 December 2004;

WHEREAS, the two statious are housed in the private-owned buildings rented by the Court of Appeals:

WHEREAS, as sites for the for the Provincial Government of Cebu donated the usufuct of a lot with an area of 2.011 square meters located near the Cebu Capitol Building and the Government of the City of Cagayau de Oro donated a lot with an area of 2,189 square meters located near the Cathedral in Cagayam de Oro City;

WHEREAS, the urgency of the need to construct the Court of Appeals buildings in Cebu City and Cagayan de Oro City is beyod despute;

WHEREAS , a part of the 20% allocation for equipment and facilities of the Judiciary Development Fund (JDF) may be used for the construction of said buildings.

NOW, THEREFORE, piMSiniaini to) amd; by virfrae oi;. Ms under Presidential Decree No. 1949, establishing the JDF, the Cheif Justice hereby appropriates the sum of P80 million from the twenty percent (20%) allocation for equipment and facilities of the JDF, for construction of the Court of Appeals buildings in Cebu City and Cagayan de Oro City on the lots donated by the Province of Cebu and the City of Cagayan de Oro, respectively, in the amount of P40 million for each.

The Committee on Halls of Justice, the Bids and Awards Committee on Halls of Justice, the Bid and Award Committee for Construction, the Prequalification Evaluation and Awards Committee for Consultancy (as strengthened in Administrative Circular No. 11-2004), and the Fiscal, Management and Budget Office, in coordination with the Presiding Justice' of the Court of Appeals, shall implement this Administrative Circular.

This Administrative Circular shall take effect upon its ratification by the Court en banc.
