Accordingly, the Petition for Review filed on May 16, 2001 is considered WITHDRAWN and this case is deemed CLOSED and TERMINATED due to the Compromise Settlement entered into by the parties. Petitioner paid the amount of P1 ,430,187.00 on July 1, 2004 (Annex "C-1 ") in settlement of its 1995 deficiency income tax assessment, representing 40% of the basic tax of P3 ,575 ,467 .00.
